Subject of Durham standoff out of hospital, in jail

Durham, N.C. — The man who held Durham police at bay for seven hours Sunday evening was in custody Monday night.
Donald Simmons, 49, was charged with kidnapping, interfering with emergency communications, going armed to the terror of the public, assault by strangulation and discharging a firearm within the city limits.
Police surrounded a home at 500 N. Guthrie Ave. after a woman called 911 to report a domestic assault. The woman and her child got out of the house safely, but police waited until after midnight to throw tear gas into the house and take Simmons into custody.
Simmons was transported to Duke University Medical Center to recover from the tear gas, and was released Monday and jailed on $30,000 bond.
