Summary: The 2017 Farm Act passed with strong bipartisan support and was signed into law by Gov. Roy Cooper in July. The bill is broad in scope, running 24 pages and touching on a number of areas of state laws dealing with agriculture. The Farm Labor Organizing Committee, on behalf of two fam workers, filed suit over two provisions. One forbids farmers from deducting union dues from worker paychecks, which is commonly known as a “dues checkoff” agreement, and the second declares invalid any agreements between agricultural employers and unions. FLOC alleges that the two provisions violate the constitutional right of free association among farm workers.

In the real world: The Farm Act and the contested provisions are currently state law.

Where it stands: Cooper hasn't yet responded to the lawsuit.
