State trooper cleared of rape allegation

Trooper Bryan R. Phillips, who is based in Wilmington, was accused of an off-duty sexual assault in July, authorities said.

New Hanover County District Attorney Ben David reviewed the evidence collected by Wilmington police and the State Bureau of Investigation and said he found no evidence of criminal conduct. He cited records of text messages and phone calls that he said show the alleged victim and Phillips had a consensual sexual relationship.

Phillips, who has been with the Highway Patrol for seven years, remains on administrative duty until the Highway Patrol completes an internal investigation.
