Smithfield man charged with statutory rape

— A Smithfield man has been charged with statutory rape, according to authorities.

Tavian McLamb, 19, was being held under a $150,000 bond in the Wake County jail on Thursday.

McLamb was ordered not to have any contact with the 13-year-old victim.

According to an arrest warrant, the charge stems from an incident last month.

    Statutory rape simply means he had sex with her and she was under 18. That is the law, point blank, whether she consented or not, he broke the law and now must suffer the consequences. Everyone should be ready to accept their consequences when they decide to break the law.

    Wow,the teacher on another story was 36 yrs old and the boy was 14 (bail $5,000) This 19yr old was involved with a 13 yr old and he gets reemed with 150,000

    I dont think there are enough details to make an assumption on this story yet. If she was a willing participant then no I don't think he should be labled a sex offender and deserve jail time. If that wasn't the case, then yes he does. But I know alot of 13 years olds that are willing participants and the parents should be held accountable. At 13, parents should know where your kids are and who they are with. My teenager at 13, was supervised and didnt have an opportunity to get himself into situations where this was a possibility. Now that he is older, its a little harder I must say. I can only pray, he was raised to know the difference between right and wrong and pray that he chooses to make the right decisions. So far, so good, lol! Parents are giving their kids entirely too much freedom and indenpendance younger and younger these days!

    bill, do you think if it was just a case of him dating this 13 year old the bail would be $150,000? I don't, I think there is more to this story than the press can release because of the age of the minor. And if that turns out to be the case, then yes, jail and life long sex offender needs to be hung on him.

    Would you think the same if a 66yr old robbed the cradle with a 60 yr old? It isn't just the age difference, it is the ages.

    While 13 yr olds don't make good decisions, they do make decisions. This is like a Freshman dating a senior. The parents obviously shouldn't like it or encourage it. Should the young man go to prison though? Should be he branded a sex offender and required to register for his entire life? It just seems like this is something the parents should be handling, not the legal system.

    Where was her mama? I always knew where my 13 yo was and who she was with. Lol She never had the chance to do any funny business but I am pretty sure it really wasn't much of a thought to her at the time! When will parents start parenting... Bring back Virginity until marriage! Stop tolerating babies having babies.

    I think this is awful and do think there is too big of an age difference and completely inappropriate. I live in Clayton, and have a teenage son and can tell you right now times have changed. These girls are premiscuious at 13 and doing more things younger and younger as they start middle school, it is very scary. No excuse for this and he should know better. 13 is too young, but it doesnt surprise me around here.

    The same thing happened to a classmate in high school. He was an 18-year-old senior and she was a 14-year-old freshman and they had been dating for the entire school year. Long story short her parents didn't like him, reported him to police, and he had to do a little jail time as a result. That's why the term "jail bait" was coined... for situations just like these.

    He is an adult, she is still a child. If she was 16 or 17 I'd say they got it wrong, but not this time. And jlh, did you see what the bail was? $150,000.00, Apparently the courts felt it was worthy enough to set a high bail, it's not like the bail is 1500.00, So there may be information being left out to protect the victim not the assailant.

    I do agree with jlh4jdj, there isn't a reason to have this posted this soon as if he is a serial rapist, or he has even had any court appearance and trial at all. I have my reasons though on why his story and picture are posted so quickly. Sad thing is, there are other stories similar to his in the court files, but he was chosen as today's poster of crime.
