PRANK CALL PERIOD! young man mother say a hacker got on his computer system? his defence? this authorities take and keep them from each other? child they keep from his own mother? talk about extreamist threat to ones rights? a child" this is how our goverment treats children over nothing more than prank call? which he says he did not do? priority! parks taken over by drug gangs and people are told to stay out because they are armed? armed and protecting their dope crops in america live? i think that was georgia? priority? storm troopers invade widow mother and childs home on bomb threat call find nothing? held and taken out of state? by waco national guard veterans you think? priorities extreamist goverment? homeland security borders ports left wide open? priorities? action? hate crimes? extreamist?     16 year old kids are not terrorists, at least not unless raised in a Madrassa in dunghill country in Pakistan and indoctrinated since birth to be one. Even if there is any truth to the allegations it should be handled by the juvenile justice system. In times of crisis bad decisions are made by lawmakers. The Patriot Act, in certain respects, was a bad decision. Someone should alert as many media people as possible about this case and it should make the rounds of talk radio in order to get the word out. There is absolutely no excuse for violating the constitution. When due process is ignored the rule of law disappears. This is a truth firmly entrenched in western concepts of government since the Magna Carta.

    The Feds do not have to announce they are acting under the Patriot Act. Why is a teenager shipped to Indiana. NC has no youth facilities the feds can use? Maybe it is because Indiana has a high population of home schoolers, but most don't hate guns.
    From watching 24 you can hijack an IP Address, but unless they hacked directly into the computer the 'experts' can determine if the activity happened on that specific computer.

    This story seems to be missing several parts. I do not understand-however, the so much being seeled, we may not know for a while.

    Anyway, for all of you so scared of the Patriot Act, we had to do somethig to nab terrorists quickly without waiting for some liberal judge to sign a warrant. I know this reeks of Fascism,
    but, it had to be done in this case.

    You need to be worried about a President "giving" auto companies to the Unions(should make for great negotiations), replacing CEo's with his cronnies, threatening banks, actually bulliing corperations,
    snubbing the Brisish PM(our most sacred ally), kissing the hand of a Saudi Prince(how many 9-11 guys were Saudi?), snubbing the Christian world on the National Day of Prayer, and ....

    Read the article more closely please. The only person in this article claiming that the Patriot Act is in play here is the mother. Authorities have their usual 24 hours to declare on what charges they are holding this minor. To rush to blame Patriot Act in this case is ignorant of the powers of the Patriot Act and being done to satisfy some other agenda I believe.

    The only thing I know about this case is what has been printed. I can't believe this case is not getting more attention in the media.

    How would you feel if this were your son sitting in a detention center several states away?

    Mom started to list bomb-making ingredients, then stopped and said she didn't know how to build a bomb.

    Mom claims her son's ISP# was hacked, and then complained that his computer was taken.

    She is a home-schooling mom who "hates guns" which leads me to believe that her little darling was kicked out school so she is home schooling out of necessity.

    Mom is making incorrect claims about the Patriot Act; honesty clearly means nothing to her.

    Mom is probably hoping to rile up the populist nutz so they act unconstitutionally (and pile on the authorities) to free her guilty son.

    Is that "former" federal attorney her current boyfriend? Why else would he defend her silly claims?

    There is absolutely no reason to believe one word that comes out of that woman's mouth!

    Hey, remember slavery? NOW considered "unconstitutional"? If so, why did it TAKE A WAR to get rid of it?

    All sorts of bad, unconstitutional law gets passed, and ENFORCED, until it's stopped. Or do you think the constitution fairy takes care of such things?

    Due process was not suspended? what about the right of HABEUS CORPUS? Or the right to a SPEEDY PUBLIC TRIAL? Or the right to FACE YOUR ACCUSER?

    Whether he's guilty is not the point. The Constitution is the point. It is to be followed regardless of presumed guilt or innocence. Any supposed "law" that violates the Constitution is no law at all. Any legislature that has anything to do with passing such a law is the traitor to this country and the one who should be in jail. And then after due process he/she should get what any traitor to the Constitution should get. If the Patriot Act allows this kind of abuse then it is no "Patriot" Act at all.

    I hate it when news organizations print statements from a person with no expertise in a field and then print it as fact. Like the mothers opinion of the Patriot Act. The mother is wrong about the patriot act and the patriot act has no bearing in this matter, feel free to follow the DOJ link in the story to read more.

    The Patriot Act has no bearing on this case, the kid could have been arrested prior to the Patriot Act even being enacted.

    1. Crime was committed.
    2. Crime was investigated.
    3. Discovery of IP address associated with computer at address and a connection made to the kid in the story.
    4. Search warrant, issued by a judge, was served.
    5. Evidence of crime recovered and child taken into custody.

    simple huh?.

    Kids can be held in jail awaiting trial. Nowhere in the story did it say the kid is held incommunicado, it just said, "Very little access" which probably means 1 hour weekly visit.

    Patriot Act doesn't supersede the Constitution and due process wasn't suspended.

    I would not be surprised if the present administration (which I see as saturated in corruption) had this staged as to send a message concerning the liberal hated Patriot Act. It could be a planted abuse, to show it can be abused. More discouragement from this current administration to dispirit those who wish to fight for what this country could be.

    It's a sad commentary on the state of our nation when a citizen is incarcerated with no trial or evidence shown other than hearsay. This is against the Constitution, the ultimate law.
    If the boy is guilty, he should be tried; if there is no evidence or proof, he should be set free. The "Patriot Act" is not patriotic, it is a panic reaction. It does not protect us, it puts us in the same league as our enemies.

    Remember the old saying, a conservative is a liberal who's been mugged? Well, it seems a liberal is a conservative who's been arrested for something he didn't do. The time to worry about hard-working white Americans getting scooped up by the Patriot Act was when it was being written and passed...or did we really think it would never be used on "one of us"?

    NC Homeschool Law Requirements

    -Send DNPE a Notice of Intent to Operate a School. The notice must include the name and address of the school along with the name of the school's owner and chief administrator
    ***Hold at least a HIGH SCHOOL DIPLOMA or its equivalent
    -Elect to operate under either Part 1 or Part 2 of Article 39 of the North Carolina General Statutes as a religious or as a non-religious school
    -Operate the school on a regular schedule, excluding reasonable holidays and vacations, during at least nine calendar months of the year
    -Maintain at the school disease immunization and annual attendance records for each student
    -Have a nationally standardized achievement test administered annually to each student. The test must involve the subject areas of English grammar, reading, spelling, and mathematics. Records of the test results must be retained at the school for at least one year and made available to DNPE when requested.
    -Notify DNPE when the school is no long in operation

    BTW, per NC homeschool law, a high school diploma or equivalent is required.

    Nothing is supposed to supersede the constitution. This is an example of something that sounds good until it is used immorally. This country is slowly turning into a police state, specifically a communist state. It was started under Bush, but Obama is doing nothing to stop it. It is happening gradually so people do not notice or complain. But people are being scared into doing things they would not normally do. We have to give up our rights, we are told the world will be 10 feet under water soon, we are told the Taliban is hiding in this country, and we are told the economy is in danger.

    The terrorists don't have to bomb a building to win. Global warming doesn't have to be real for the eco-nuts to win. And so forth. We are witnessing the beginning of the end. It starts with denying constitutional rights like due process.

    Agree with "Happyswimmers" and Mom, this is exactly how the Patriot Act is supposed to work, swiftly and decisively. Remember that a sixteen year is just as capable of killing thousands and if the government those not interve and stop him on time then you would be outraged that they didn't. Our justice system is not perfect but I guarantee you is the best in the entire world.

    "Dictator?" Bush indeed did sign the law that was mainly written by people from the Clinton administrator. So can we now blame Dictator Clinton for his part in the crime and Dictator Obama for continuing the charade. Some people swallow things hook, line and sinker before finding out how dumb they look.

    Too many things missing from this story. What really is going on? We don't know, do we? Did make front page news though. Go to the comic section.

    As a home schooled student, this young man is clearly intellectually superior to the average public school educated child. Obviously, if he has indeed made a bomb threat, he is the sort of individual that POTUS Obamanation deems qualified to act as presidential advisor. In all probability he is, at this very minute, up to his eyeballs working on plans to interrupt future actions of the "unclean" right-wing insurgents heretofore known as American citizens.

    Obama voted FOR the Patriot Act and he is all for renewing it. Corporations and international bankers rule the good old USA, not the president. When gun rights get stripped away we will lose all that we have left as far as freedom.

    Good grief, what horrible reporting. Far too little detail. For instance, U.S. Attorney "Dan Boyce" talks about how bad the Patriot Act is. But the article reveals that Boyce is "not connected to the Lundeby case."

    So what IS Boyce's connection to this matter? Was he sought out by the TV reporters, or the mother? Did HE seek THEM out? IS there a lawyer connected to the case? I'm having a hard time imagining any mom with a kid incarcerated and held incommunicado for two whole months, and who's convinced of his innocence, who wouldn't either a) have a lawyer already or b) be pleading for one if given the chance for a television interview.

    What serious, responsible news reporter wouldn't find out whether there's a lawyer, and interview them instead of one NOT connected? Or at least investigate why there's not one? And since the Feds provided a search warrant, why not report on exactly what was in it?

    For such an important case, this is pretty sloppy 'reporting'.

    Clearly the kid did it. It wouldn't take but a few minutes for the Feds to check his computer's history log to see that the message did in fact come from his computer. Or phone.

    They haven't been holding him this long without having done their homework here.

    We don't know what happened, because the child is being held incommunicado by the FBI! Explain that! What could a 16 year old possibly do, to justify that?
