Don't waste the time putting him in prison, he has already eaten too many meals he don't deserve.
aprilhunter220 Apr 22, 6:33 p.m.
Should have known he would try the I am crazy defense. He is not crazy now nor was he when he did it. They should put him in prison for the rest of his life and he will be taking care of in prison. Inmates do not like child molesters and child killers.
jurydoc Apr 22, 6:27 p.m.
Apparently most of you don't understand the LEGAL concept of competency. Our system requires that the defendant be competent to understand the proceedings against him and to participate meaningfully in his own defense. That is the issue of competency to stand trial. The trial is starting NOW. Thus, his mental state needs to be evaluated NOW. His mental state a year or more ago is irrelevant to a competency determination.
welfarequeen Apr 22, 6:19 p.m.
how terrible to think this - he knew in his right mind what he was doing to this little girl - i think these people need their heads examined . marciamal1
Honey, that is what is happening. He is getting his HEAD EXAMINED. So when it comes back and they say he is crazy, what will you say then? He needs his head examined but you better not say he is crazy because I want him to suffer? That is EXACTLY what you are saying madam.
V-Vet 72-75 Apr 22, 6:02 p.m.
This dude knows how to play the system. Yea! He's crazy. Crazy like a fox.
Testjmpr13 Apr 22, 6:01 p.m.
His lawyer can delay this all he wants. But if the DA and Judge screw this up there will be a great outcry of all the citizens of this state. He should have had the psych eval during the past year he has been incarcerated prior to the start of the trial. This piece of trash should have been left in the ditch.
katzlover Apr 22, 5:36 p.m.
why wait for so long .. should have been done looooong time ago..
dumb sys ...
oleguy Apr 22, 5:10 p.m.
4 years and now a delay for mental? You got to love our broken court system
marciamal1 Apr 22, 4:59 p.m.
Capacity to proceed - what the heck are they thinking - this is so ridiculous - i can't believe the judicial system - how terrible to think this - he knew in his right mind what he was doing to this little girl - i think these people need their heads examined - This makes me so sick i feel like vomiting right now - this is not FAIR - WGCFV - you are right - he would have no problem killing again - He and the mother deserve the death penalty and i hope the heck if they get a life sentence that some inmate plays with them really hard!~
tigersnpirates6389 Apr 22, 4:54 p.m.
fully agree with cghsmom!!! and jetset!!
Naysayer Apr 22, 4:05 p.m.
You would have to be out of your mind to be capable of such a horrendous crime. I am not a big fan of the death penalty, but what would happen if this guy escaped prison, he would have no problem killing again.
jetset Apr 22, 3:43 p.m.
How long has he been locked up? And, they are just "thinking" he needs to be evaluated for mental issues? Sounds like a ploy to me.
jetset Apr 22, 3:41 p.m.
Happymom--- I don't think you have to be "mentally ill" to rape and kill a child. The Devil in him, yes.
cghsmom Apr 22, 3:41 p.m.
stall tactic by the defense because they didn't get the postponement they most recently asked for. This man is sick. He's not mentally ill, he is just evil. Lets get on with his trial.
mchljam2 Apr 22, 3:03 p.m.
He can try and get out of this all he wants, but there is one time his judgment WON'T be put off and thank goodness that judge knows all!! :)
happymom Apr 22, 3:03 p.m.
"Only a mentally unstable person would rape and kill a 5 year old. Do you disagree?..."
Yes, I do. You do not have to be mentally ill in order to be a criminal. And the legal standard for being mentally competent to stand trial is that the defendent can understand the nature and object of the proceedings; comprehend his or her situation in reference to the proceedings; and assist in his or her defense in a rational or reasonable manner. It is not about having a mental illness.
Furthermore, I believe in real evil and I do not equate that with being mentally ill. An evil person rapes and kills a child.
Blue Devil 2 Apr 22, 2:57 p.m.
The media shouldn't even show his face. He always has that grin on his face. He is playing the court system. If he can torture and kill little Shanya, he is competant to stand trial. He knows what he is doing. I have to turn my head when they show his picture. Disqusting !
Grand Union Apr 22, 2:52 p.m.
"Delaying this trial? Are you kidding me. It is beyond me how this man and the child's mother are continuously shown mercy and given options"
Its called the rule of law. Be very glad that we have it because if they start picking and choosing how to apply the Constitution and who they apply it to, we all lose.
Grand Union Apr 22, 2:50 p.m.
"Can't blame the defense for trying. McNeill is a lot of things, but mentally ill isn't one of them."
Actually its almost certainly exactly what he is......no sane person would have done what he did.
Wendellcatlover Apr 22, 2:22 p.m.
I think you have to be mentally unstable to be able to do to this precious what he did. That, however, should not get him off the hook for it.
countrylynn3 Apr 22, 2:18 p.m.
Absolutely sickning! He is guilty, and every defense attorney and prosecutor should know that! Both him and her mother should be on a death penalty trial! That little girl deserves justice! Our court and justice system these days are not fare! I don't want my tax dollars supporting a poor excuse of a human being!
dwntwnboy2 Apr 22, 2:07 p.m.
He should have taken the plea deal- it won't get any better for him after a jury hears of the horrible things he's accused of.
Serendipity5 Apr 22, 1:30 p.m.
I'm so sick of his smug grins every time he appears in court.
free2bme Apr 22, 1:25 p.m.
Our justice system truly needs to be re-vamped so that all of these tax dollars will stop being wasted protecting criminals. The poor victims get no justice. The sad part is who is protecting victims and supporting their families- that is where the tax dollars ought to be going. It is just sickening to know that tax dollars have to wasted on things like this.
Barfly Apr 22, 1:23 p.m.
Can't blame the defense for trying. McNeill is a lot of things, but mentally ill isn't one of them.
shakenbake68 Apr 22, 1:17 p.m.
"I disagree. A truly evil but stable person can commit any number of heinous acts. Just ask Adolph Hitler"
Hitler was quite the opposite of "stable". He was a paranoid schizophrenia, a psychotic, and a sociopath, among other things.
sayhi2me2010 Apr 22, 12:55 p.m.
Delaying this trial? Are you kidding me. It is beyond me how this man and the child's mother are continuously shown mercy and given options. What options did that child have? Not let him showing them where the child's body is be told in court? Really?? if he didn't kill her then how did he know. Both of these monstors need to be executed. Save the taxpayers some money on two enourmous waste of space. Justice should have been swift and deadly from the start. Now this joke, trying to delay the trial and escape death? Unfreakingreal. I would love to be on this jury.
publicassistance Apr 22, 12:45 p.m.
Well, I suppose any grown man that would purchase, rape, abuse, and murder a 5 year old child must have a "mental claim"....
Let's hope that whatever needs to happen, we can get this waste of humanity put under ground or behind bars permanently as quickly as possible.
yindaworld Apr 22, 12:43 p.m.
okay ....so let's get this straight ..you were "smart" enough to write a letter to the fayetteville observer stating you didnt do it....that took you forming letters to make sentences...then you had to seal the envelope and address it all by yourself to the fayetteville observer...you probably had to do reaseach to find the address or at least ask someone for it...and you KNOW in your right mind that would be made public...also you admited to several things already...you understood that you didnt want life in prison because in your sick mind you really think your going to get away with this...I pray to the good man upstairs that the people evaluating you have enough common sense to realize your playing games with everyone...you are a piece of trash (sorry for the misspelled words just LIVID after reading this)
MonkeyFace Apr 22, 12:39 p.m.
you have got to be kidding me... seriously? but then again only an insane person could do what he did to this little girl.
zonk Apr 22, 12:31 p.m.
This should have already been determined. Wasting and abusing system and he is mental alright. I can tell you that !!!
jurydoc Apr 22, 12:27 p.m.
BTW, just a point of clarification. The difference between competence and insanity is the time period. Insanity deals with mental state AT THE TIME OF THE COMMISSION OF THE CRIME. Competence deals with mental state AT THE TIME OF THE PROCEEDING IN QUESTION. Interestingly, once can be deemed incompetent to be executed. If this happens, the person is remanded to prison to be "rehabilitated" to competence so that s/he can be put to death.
OneLove Apr 22, 12:26 p.m.
Raise your hand if you want to see his face on EVERY STORY connected to the case! I know the CASE without having to see his FACE!
jwjsdj Apr 22, 12:25 p.m.
Mental "Claim" ! Playing Games, Abusing the System !
mac240 Apr 22, 12:21 p.m.
All these delays are designed to desensitize the jury and create sympathy for the accused! How someone can be a defense attorney in some case and still sleep at night is beyond me!
itsmyownopinion Apr 22, 12:16 p.m.
He's just EVIL that's all.
jurydoc Apr 22, 12:13 p.m.
This is not about the insanity defense. This is about competency to stand trial and his ability to understand the proceedings and participate in his own defense, which is a constitutional right. Ironically, his rejection of the plea deal which obviously would have been to his advantage, may have played a role in the attorneys' asking for this evaluation. BTW, if he is adjudicated incompetent he does NOT "go free." He will be incarcerated and treated until such time as he can be deemed competent and then will stand trial. If he is never adjudged competent, he stays incarcerated indefinitely.
torchhappysean Apr 22, 12:02 p.m.
There is no question on his mental state.. Who in their right mind would do that to a 5 year old?? Just another waste of time on a case that should have been over months ago..
godshelper Apr 22, 11:45 a.m.
All this time and now its time to hand down justice and all of a sudden he is a mental patient and needs evaluation. Our justice system is corrupt.
Terkel Apr 22, 11:43 a.m.
I can't help but draw parallels between the insanity plea and all the made-up "disabilities" that lazy or inept parents have allowed to proliferate, with a willing and greedy hand from the medical industry and teachers. "I can't work, I have Adult ADD" (as now hawked by a sports figure); "I'm not accountable, it was my ODD"; "Johnny's too active, drug him into a stupor or he's expelled".
And now, this pos is "insane".
Sow the PC wind, reap the murderous whirlwind.
vile garbage Apr 22, 11:42 a.m.
Want to hear an awesome joke? The Court System.
bill0 Apr 22, 11:40 a.m.
"Incredible! What else can be said about this further delay? He has been jailed for 3 1/2 years and now the defense needs to find out if he is "sane"?"
Well, it was the judges and prosecutors that caused the 3 1/2 year delay so far. The defense has asked for additional delays previously but were always turned down.
emprezzinez Apr 22, 11:38 a.m.
wow...this is a sick joke
csmith517 Apr 22, 11:37 a.m.
OK, here we go.......unfreaking believable
Weetie Apr 22, 11:35 a.m.
I really really really would like to be a juror in this trial!
JAT Apr 22, 11:32 a.m.
Absolutel amazing! Waste all this time and moiney and after all this time, NOW they decide to test him. He's perfectly sane - get on with the show.
zenonx6 Apr 22, 11:28 a.m.
Just another ignorant druggie that went too far and now he's scrambling for his life which isn't worth his salt.
justcommonsense Apr 22, 11:27 a.m.
Sigh.... I agree with others, this should have been taken care of at the beginning. This last ditch jockeying to try to avoid the death penalty is absurd and everyone knows it.
Enough of the delays already. He needs to go to trial and be sentenced (upon conviction of course) He led them to the body...that tells me all I need to know. Remove the scourge.
zenonx6 Apr 22, 11:27 a.m.
Last minute he's gonna claim insanity which he would have to be to snuff kill this poor beautiful child BUT I say that either way he needs to disappear.
Brogden Apr 22, 11:23 a.m.
Incredible! What else can be said about this further delay? He has been jailed for 3 1/2 years and now the defense needs to find out if he is "sane"??? I am thinking they would have observed enough interaction with others - and himself! - while in lock up to know that!
Defense attorney's are a special breed! And, notice he "chose" the shrink to do the evaluation!!! Smart guy!!!
