    Should have known he would try the I am crazy defense. He is not crazy now nor was he when he did it. They should put him in prison for the rest of his life and he will be taking care of in prison. Inmates do not like child molesters and child killers.

    Apparently most of you don't understand the LEGAL concept of competency. Our system requires that the defendant be competent to understand the proceedings against him and to participate meaningfully in his own defense. That is the issue of competency to stand trial. The trial is starting NOW. Thus, his mental state needs to be evaluated NOW. His mental state a year or more ago is irrelevant to a competency determination.

    Honey, that is what is happening. He is getting his HEAD EXAMINED. So when it comes back and they say he is crazy, what will you say then? He needs his head examined but you better not say he is crazy because I want him to suffer? That is EXACTLY what you are saying madam.

    His lawyer can delay this all he wants. But if the DA and Judge screw this up there will be a great outcry of all the citizens of this state. He should have had the psych eval during the past year he has been incarcerated prior to the start of the trial. This piece of trash should have been left in the ditch.

    Capacity to proceed - what the heck are they thinking - this is so ridiculous - i can't believe the judicial system - how terrible to think this - he knew in his right mind what he was doing to this little girl - i think these people need their heads examined - This makes me so sick i feel like vomiting right now - this is not FAIR - WGCFV - you are right - he would have no problem killing again - He and the mother deserve the death penalty and i hope the heck if they get a life sentence that some inmate plays with them really hard!~

    Yes, I do. You do not have to be mentally ill in order to be a criminal. And the legal standard for being mentally competent to stand trial is that the defendent can understand the nature and object of the proceedings; comprehend his or her situation in reference to the proceedings; and assist in his or her defense in a rational or reasonable manner. It is not about having a mental illness.

    Furthermore, I believe in real evil and I do not equate that with being mentally ill. An evil person rapes and kills a child.

    Absolutely sickning! He is guilty, and every defense attorney and prosecutor should know that! Both him and her mother should be on a death penalty trial! That little girl deserves justice! Our court and justice system these days are not fare! I don't want my tax dollars supporting a poor excuse of a human being!

    Our justice system truly needs to be re-vamped so that all of these tax dollars will stop being wasted protecting criminals. The poor victims get no justice. The sad part is who is protecting victims and supporting their families- that is where the tax dollars ought to be going. It is just sickening to know that tax dollars have to wasted on things like this.

    Delaying this trial? Are you kidding me. It is beyond me how this man and the child's mother are continuously shown mercy and given options. What options did that child have? Not let him showing them where the child's body is be told in court? Really?? if he didn't kill her then how did he know. Both of these monstors need to be executed. Save the taxpayers some money on two enourmous waste of space. Justice should have been swift and deadly from the start. Now this joke, trying to delay the trial and escape death? Unfreakingreal. I would love to be on this jury.

    Let's hope that whatever needs to happen, we can get this waste of humanity put under ground or behind bars permanently as quickly as possible.

    okay let's get this straight were "smart" enough to write a letter to the fayetteville observer stating you didnt do it....that took you forming letters to make sentences...then you had to seal the envelope and address it all by yourself to the fayetteville probably had to do reaseach to find the address or at least ask someone for it...and you KNOW in your right mind that would be made public...also you admited to several things understood that you didnt want life in prison because in your sick mind you really think your going to get away with this...I pray to the good man upstairs that the people evaluating you have enough common sense to realize your playing games with are a piece of trash (sorry for the misspelled words just LIVID after reading this)

    BTW, just a point of clarification. The difference between competence and insanity is the time period. Insanity deals with mental state AT THE TIME OF THE COMMISSION OF THE CRIME. Competence deals with mental state AT THE TIME OF THE PROCEEDING IN QUESTION. Interestingly, once can be deemed incompetent to be executed. If this happens, the person is remanded to prison to be "rehabilitated" to competence so that s/he can be put to death.

    This is not about the insanity defense. This is about competency to stand trial and his ability to understand the proceedings and participate in his own defense, which is a constitutional right. Ironically, his rejection of the plea deal which obviously would have been to his advantage, may have played a role in the attorneys' asking for this evaluation. BTW, if he is adjudicated incompetent he does NOT "go free." He will be incarcerated and treated until such time as he can be deemed competent and then will stand trial. If he is never adjudged competent, he stays incarcerated indefinitely.

    I can't help but draw parallels between the insanity plea and all the made-up "disabilities" that lazy or inept parents have allowed to proliferate, with a willing and greedy hand from the medical industry and teachers. "I can't work, I have Adult ADD" (as now hawked by a sports figure); "I'm not accountable, it was my ODD"; "Johnny's too active, drug him into a stupor or he's expelled".

    Well, it was the judges and prosecutors that caused the 3 1/2 year delay so far. The defense has asked for additional delays previously but were always turned down.

    Sigh.... I agree with others, this should have been taken care of at the beginning. This last ditch jockeying to try to avoid the death penalty is absurd and everyone knows it.

    Enough of the delays already. He needs to go to trial and be sentenced (upon conviction of course) He led them to the body...that tells me all I need to know. Remove the scourge.

    Incredible! What else can be said about this further delay? He has been jailed for 3 1/2 years and now the defense needs to find out if he is "sane"??? I am thinking they would have observed enough interaction with others - and himself! - while in lock up to know that!
    Defense attorney's are a special breed! And, notice he "chose" the shrink to do the evaluation!!! Smart guy!!!
