The father is just as guilty as the mother. He had been advised to remove her from the mother, that she was in a bad environment, and he did nothing to protect her. He should have protected her at all cost.
    wlbbjb

I TOTALLY AGREE!!! Does anyone not think the father should be held accountable for this also? He knew what type of environment his child was in & he did NOTHING to fix it! I'm a single father & I KNOW if you r in that child life, u can see when things aren't right! I feel sorry for the victim, "Shaniya" I feel the father should be held accountable for his LACK of fatherhood also!!!

  • gr8Brit Apr 9, 11:22 a.m.

And when he is sentenced to death just take him downstairs from the courtroom and hang him in the basement, don't put him in prison for years wasting all my tax dollars.

  • NotUrTypicalAmerican Apr 9, 9:55 a.m.

McNeill rejected the plea. Good. The sick psycho needs the death penalty.

  • PJM Apr 9, 9:54 a.m.

BURN BABY BURN........This man destroyed a childs life and neither her mother nor this crumb of a mans life need to be spared. "plea deal" are you serious! That child did not have a change to plea for her life...again neither one of them deserve their next breath of air.

  • For the U.S.A. Apr 9, 9:54 a.m.

Instance death for killing or raping a child! Get it over with NOW!

  • bill0 Apr 9, 9:54 a.m.

"This guy is THINKING ABOUT THE PLEA? If I was him I would have grabbed it instantly and got down on my knees to thank the powers that be for this unbelievably generous offer."

Well, he says he is innocent. So far, the public records available suggest the prosecutors have no evidence against the guy other than photos of them together - with the girls still very much alive. If he did accept this girl as payment for a drug debt, it is entirely possible that he just turned around and re-sold her for cash.

"went inside a Russian Prison.... then just MAYBE it would deter some crime."
You do realize that russia is an incredibly violent and corrupt country, right? Their prison system obviously isn't something to model.

  • buford Apr 9, 9:53 a.m.

Breaking News: Mario Andretti McNeill maintained his innocence Tuesday and rejected a plea deal in the capital murder case of a 5-year-old Fayetteville girl. Prosecutors say McNeill raped, kidnapped and murdered Shaniya Davis in 2009. He could face the death penalty if convicted.

    I have a feeling he's going to walk...please don't let it happen...

  • Jimmytwotimes Apr 9, 9:51 a.m.

Alright he rejected it, that means death penalty!

  • NoObamaCare Apr 9, 9:47 a.m.

Sounds like he just rejected the plea deal...He must be going for the INSANITY plea after that move!

  • Kaitlyn Apr 9, 9:45 a.m.

Well he rejected the plea deal so the DP is back on the table.

  • ncouterbanks69 Apr 9, 9:37 a.m.

"I watched a Nat-Geo Special where they went inside a Russian Prison. I highly recommend folks see it. If Prison here was more like that, and not a country club, then just MAYBE it would deter some crime."

Agreed. This country (and we know why) cuddles criminals instead of actually punishing them. A TV in prison???? Really? They should have to grow their own food as well.

  • Kaitlyn Apr 9, 9:35 a.m.

"And if we did not have the whiny liberal crowd that is what would happen."

Don't forget about the "whiny libertarians" and "whiny conservatives" who also think capital punishment is wrong.

  • monami Apr 9, 9:30 a.m.

Both McNeill and the mother deserve the death penalty. And I don't even believe in the death penalty. This guy is THINKING ABOUT THE PLEA? If I was him I would have grabbed it instantly and got down on my knees to thank the powers that be for this unbelievably generous offer.

This is the most heinous crime I have ever heard of. There is no redemption possible for two people who would do such a thing. It makes me yearn for "cruel and unusual punishment" for them. Utterly sickening.

  • mac240 Apr 9, 9:29 a.m.

I would love to see a judicial system that puts the victim first!

  • Whatdaheck Apr 9, 9:28 a.m.

This is one of those cases where I actually think a public execution may actually be in order.

  • alacarteautomotive Apr 9, 9:19 a.m.

There is no fear of prison. He doesn't care, and thats why he is smiling and looking smug. He, like all other felons, will get food, healthcare, lodging, free college degree, and a slew of other "bennies" us law abiding folks don't get. Once he gets to prison he will continue to live and "bang" like he did on the block. The only difference is a slightly smaller and more "structured" world for him otherwise its going to be business as usual. He'll get to prison, find his "hustle" and life is good. It's time we got serious with this stuff! I watched a Nat-Geo Special where they went inside a Russian Prison. I highly recommend folks see it. If Prison here was more like that, and not a country club, then just MAYBE it would deter some crime. But you can see it in his face in the courtroom, he don't care, no remorse and no worry about the future as he will be cared for by the bleeding heart libs.. Prison SHOULD be something to fear, and it SHOULD be a miserable experience!!!!!

  • surfin252sr Apr 9, 8:58 a.m.

Why is it in NC it takes 3 to 5 years to bring murder cases and other serious felonies to trial. In Wisconsin a man went on trial last week for the murder of his 3 daughters. The crime happened July '12. Judges don't care, they are going to get their pay regardless. They don't press the issue, lawyers run the courtroom, and get paid by the hour. Judges don't rock the boat, it may impact re-election

  • ncouterbanks69 Apr 9, 8:57 a.m.

"He needs to be put to death. Anyone who would rape and murder an innocent child doesn't deserve to live."

And if we did not have the whiny liberal crowd that is what would happen. No way does this monster deserve to live but you have too many people out there that want to protect these types. Why? If you figure that one out please let me know.

  • showard Apr 9, 8:55 a.m.

I don't care if he gets life in prison but the death penalty should be on the table for her mother she should die like her child did I hope he pleads so this will end with him because she is going to plea if he does this case is a case that will cause anyone with a heart heartache and 2 mos is a long time.

  • MonkeyFace Apr 9, 8:45 a.m.

I say, let him spend life in prison. If you let him out with all the other convicts, I'm sure they will have great plans for him. I hear other convicts love to get their hand on guys that do this to kids. Or just let him out and let the public deal with him. I'm sure he won't last long either way!

  • MonkeyFace Apr 9, 8:42 a.m.

"Public defenders Harold "Butch" Pope and Terry Alford argued that McNeill's previous lawyer allowed him to make statements that helped investigators find Shaniya's body under an agreement that the death penalty wouldn't be pursued in the case." Its amazing how it went from, " our client isn't guilty", to this statment! If he wasn't guilty, then how did he know where her body was to help investagaters find it?

  • TTDD Apr 9, 8:38 a.m.

Really? This piece of dung is named Mario Andretti Mcniell? Is he Italian or Irish? He does not look either. Looks like a typical Projects boy.

  • dirkdiggler Apr 9, 8:33 a.m.

look at this scumbag smiling in the video still. he does not deserve the ability to smile after what he did to that little girl.

  • Bartmeister Apr 9, 8:30 a.m.

I'm not usually for plea deals but I have to agree with jurydoc, seems the best route to take (without having inside intimate knowledge) of the case. It ensures life without parole. If the defense doesn't take it then there might be more to this than has been exposed.

  • Whosays Apr 9, 8:29 a.m.

They are offering the scum of the earth a plea deal, he only deserves the treatment the little girl got, she got no plea.

  • goalflinger Apr 9, 8:18 a.m.

I have not followed this story in minute detail but do I understand the plea-deal offer to mean that they do not have conclusive evidence that he is guilty beyond the shadow of a doubt? If they do have this evidence, then I do not understand why a plea-deal is offered.
In any event, how many more children must die this way before we will permanently wipe the smile off these smirking faces...

  • davidtew2005 Apr 9, 8:17 a.m.

The fact that the DA would offer this guy a deal like this just shows that DA's are not seeking justice, just and easy conviction. This guy deserves death if anyone ever did.

  • halfpint1552 Apr 9, 8:08 a.m.

He needs to be put to death. Anyone who would rape and murder an innocent child doesn't deserve to live.

  • Alexia Apr 8, 7:56 p.m.

"The father is just as guilty as the mother." --wlbbjb

It's not fair to go so far. It's been a while, but as I recall from when the story first came out that the father believed that the mother had gotten her act together. In any case, what person on Earth would have ever thought somebody -- especially a mother -- would allow such a thing to happen to her little girl?

If the devil had horns and a side-kick, I think we found them here.

  • wlbbjb Apr 8, 7:38 p.m.

The father is just as guilty as the mother. He had been advised to remove her from the mother, that she was in a bad environment, and he did nothing to protect her. He should have protected her at all cost.

  • Sherlock Apr 8, 7:37 p.m.

The offer a plea when they know they can not win the case.

  • Proud Liberal Apr 8, 7:32 p.m.

The father of the little girl have my sincere condolences. Whomever killed this little girl should expereniced the same outcome. But we ALL will never find out.

  • Proud Liberal Apr 8, 7:30 p.m.

As a Proud Liberal, this guy and this so-called mother would not get any mercy from me. If they killed this little girl, they should be put to death like wise; No plea deal! This story is well known throughout United States. It took three years to find out who killed this little girl?

  • jetset Apr 8, 7:21 p.m.

Thank you Jurydoc. However, that scumbag still needs frying. If he says he is innocent, how would he even know where to find that innocent, sweet child who was offered as a "sacrifice" for a drug payment?

  • kidsrn Apr 8, 7:08 p.m.

They both (McNeil and Shaniya' s "mother") deserve the death penalty. No question, no delay.

  • jurydoc Apr 8, 6:57 p.m.

jetset - Read my comments. They'll help explain. No one can really know for certain except the prosecutor.

  • jurydoc Apr 8, 6:54 p.m.

"Public defenders Harold "Butch" Pope and Terry Alford argued that McNeill's previous lawyer allowed him to make statements that helped investigators find Shaniya's body under an agreement that the death penalty wouldn't be pursued in the case."

Ah, there's the rub. Although the judge said there is "no evidence of the arrangement" the defense attorneys may have subpoened the prior attorney to testify. Check the witness list. It may explain the plea deal.

  • jetset Apr 8, 6:53 p.m.

Someone that is familiar with the law please answer this question: WHY WOULD PROSECUTORS OFFER A PLEA DEAL?????

  • Walkin Man Apr 8, 6:47 p.m.

It would be worth the extra time/money to execute this piece of trash.

  • avidreader Apr 8, 6:38 p.m.

This is one thing I don't mind my tax dollars being used for - prosecuting filth like this. He deserves to die multiple deaths for what he did, and so does the mother.

  • pgonz62 Apr 8, 6:29 p.m.

McNeil and Davis, both should be made to run a Gauntlet with their eyes blindfolded and their arms tied behind their backs, give them the same chance they gave Shanlya.

  • roncooksr Apr 8, 6:15 p.m.

WHAT IS WRONG WITH THE LAW? WAS THIS LITTLE GIRL OFFERED A PLEA DEAL? ARE THE LAWYERS TO LAZY TO DO THEIR JOB? IF HE DID IT THERE SHOULD NOT BE A PLEA DEAL OR LIFE IN PRISON. WILL IT COST TO MUCH TO TAKE THE TIME IT TAKES FOR TRIAL? WHAT WILL IT COST TO KEEP HIM IN JAIL THE REST OF HIS LIFE? THERE IS NO REASON WHAT SO EVER A CHILD SHOULD HAVE TO GO THRU THIS. THE LAWS NEED TO BE CHANGED TO MAKE A PERSON THINK ABOUT THE CRIME

  • Lamborghini Mercy Apr 8, 6:13 p.m.

I really can't believe the prosecutor offered a deal. If I was the father of this child I would demand this prosecutor aim for the death penalty. Sometimes it's better to risk losing, seeking full justice than to watch guys like this get a life sentence.

  • dorindarindy Apr 8, 6:07 p.m.

Plea deal? I wish i could flip the switch on them both. This case broke my heart, and that picture of her in his arms taking that child in that hotel room sickens me. i am so sorry for little Shaniya. She must have been so scared and confused. I have no sympathy whatsoever for either one. There is no punishment fitting this crime except death. That poor child. I just can't imagine. I really can't.

  • Ex-Republican Apr 8, 6:04 p.m.

"Prosecutors said they wouldn't seek the death penalty against McNeill if he pleads guilty"

I'm usually against the death penalty, but if this case doesn't deserve it then nothing does!

  • bluecanary Apr 8, 6:00 p.m.

No way should this monster get any leniency or any deals. It's disgusting enough that it was even implied that they would negotiate leniency with him for revealing where he dumped the baby after he raped and murdered her.

  • Conservative Apr 8, 5:56 p.m.

southraleighbro - most of the time the DAs and judges run unopposed. So nothing can be done unless good people also run and even more importantly WIN.

  • bluepenguin5oh Apr 8, 5:55 p.m.

EVERY single person involved with this (ie the So-called solcial workers , supervisors ect ect) should be charged with a felony !! As for the KILLER and the EGG-DONOR (also called the ,ummm , mother) should get the death penalty but 1st they should serve their jail time before the execution in the GENERAL population (not in protective custody) in Gen. Pop they WILL get their "dues" ..... Gen. Pop. soooo abhors baby killers , child rapist , selling the kids for evil... and with these 2 doing all 3 , well , they WILL indeed get their "dues" !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

  • southraleighbro Apr 8, 5:45 p.m.

THI IS SO SICKEN TO THE AMERICAN PEOPLE I JUST CANT BELIEVE HOW NC JUDICAL SYSTEM CAN LET A MAN LIKE THIS TAKE A CHILDS LIFE AWAY FOR HUMAN TRAFFICKING AND THE MOTHER LET THIS MAN DO THIS TO HER CHILD IN ORDER TO PAY A DRUG DEAL SHE OWED TO HIM, ITS SO SAD ONCE AGAIN AND SICKENING TO LET THIS MAN GET OFF ON AN PLEA DEAL WHEN HE SHOULD WHEN HE WAS SEEN BY HOTEL SURVEILLANCE CAMERAS WITHT HIS CHILD AND ALL. THE DA IS NOT DOING A GOOD JOB WE AS THE CITIZENS OF NC NEED TO ELECT BETTER OFFICIALS TO SERVE THE COURTS AND TO DO THESE TRAILS BETTER, CAUSE WE AS TAXS PAYERS SUFFER WHEN ITS DONT EXCUTUED TO THE RIGHT DUTIES AND IF I WAS THE JUDGE IN THE CASE THERE WILL BE NO SITTING BACK IN JAIL,NO PLEA DEAL AND SO FORTH, THATS THE SAME THING WITH THE CRYSTAM MAGUM CASE IN DURHAM NC I GUESS IT VARIES AMONG DIFFERNET COUNTIES WE SERVE AND PAYS TAXES IN>

  • Testjmpr13 Apr 8, 5:40 p.m.

Any plea deal what so ever is criminal. Surely the DA can not be doing this. The DSS doesn't even deserve a plea deal in this case.
