A lot of people don't realize that the Ten Commandments are correctly interpreted as saying "You should not murder", -not- "You should not kill".

There's a difference, although the core end result is the same, a physical body no longer functions.

It's justifiable, or lawful, to kill someone that's trying to murder you.

Yes, in part, both are technically "killing", but the -complete-, the whole definition of both, is where the difference in the two acts is found.

  • TVs_Deceit Feb 22, 2013

    mur·der (mûrdr)
    n.
    1. The unlawful killing of one human by another, especially with premeditated malice.

  • jimcool59 Feb 22, 2013

Murder is not defined as unlawful, ya got google look it up.

  • TVs_Deceit Feb 22, 2013

I meant "unlawful". Self defense is lawful use of force, and murder is defined as an "unlawful" act.

  • TVs_Deceit Feb 22, 2013

jimcool59, you're the one that needs the IQ test. Murder is defined as "unjustifiable". Self defense is not unjustifiable.

  • jimcool59 Feb 22, 2013

Did you know that you can murder someone in justifable self defense. Yeah its called self defense. Murder simply means to take anothers life. Protect you and yours against a violent home invasion and then tell me again you should get a life sentence. There should be a IQ test before people here are allowed to comment.

  • mcraineycrazies Feb 22, 2013

im sorry but if you murder someone, you should automatically get a life sentence, this bum will be out in years and do it again

"Terrible! So just because one person isn't a white blonde girl they don't deserve the same justice? This guy was shot in the head between the eyes. This had to have been an execution style murder and they're dropping first-degree murder charges? Racism and injustice alive and well in 2013."

Really? Think about what you just said..."Racism and injustice alive and well in 2013" because they are DROPPING the charges against an AFRICAN AMERICAN because of lack of evidence connecting him to the crime. So what you're saying is they should KEEP him in jail for the crime when they have insufficient evidence linking him to it? Wait a minute...then you could claim racism and injustice was alive because there is no evidence against him and they were not dropping the charges because he is african american. Amazing. SMDH...STOP FUELING THE FIRE OF RACISM WHERE IT DOESN'T EXIST SO THAT WHEN IT DOES SHOW IT'S UGLY HEAD SOMEONE WILL ACTUALLY LISTEN!!!!!

"Racism and injustice alive and well in 2013." -zhongguoguy87

    DA who dropped charges: http://www.wral.com/news/news_briefs/story/10674008/

If you think racism is involved you could always contact Eric Holder or Obama. Oh wait, that might not go anywhere LOL

Abhijit Mahato was shot once in the head with a handgun, execution style. Eve Carson was shot several times, including a shotgun blast to the head. Is that not execution style? Maybe if you took a break from race-baiting you might find a difference in the strength of evidence, the age of the murderers, etc. between the two cases. Or you could just keep up the noobish race-baiting tactics while we laugh at your lack of self-education.

Yeah you are doing a good job contributing. Read the story again. Originally two people were charged. One of those folks is still charged, it is just Oates that is no longer charged with murder. As the story says, they have not enough evidence to charge Oates.

  • Rebelyell55 Feb 22, 2013

Sounds like they got the real killer, this was just gonna be an add on. But four counts he has yet to be tried on, should put in prison anyway. for about 30 days and time served.

  • whatelseisnew Feb 22, 2013

It will not be long and this guy will kill someone else. Since they can not prove it they have no choice but to drop the charges. I am surprised this was not a typical blaming it on the gun as seems to be the popular phrase. GUN violence. Nope, it is murder. Sometimes guns are used and other times a different weapon is used.

  • carolinarox Feb 22, 2013

it is sad that both cases have not had the same amount of media on them, seems like the eve carson case trumped over this poor guy.. think if it was your family that this happend to, its just really an unjustice. Click to view my profile mcraineycrazies

Michael Jackson and Farrah Fawcett died on the same day. MJ got much more media coverage than the white blonde woman.

  • zenonx6 Feb 22, 2013

Theft of a fire arm should be a life sentence.

  • Barfly Feb 22, 2013

I wonder if Oates will be out on the streets since his other charges are considered minor offenses in Durham County?

  • tierneemalinadeveaux Feb 22, 2013

If the charges are being dropped, then I hope he is truly not the killer.

"oh ok... he only robbed and killed one person and not two... glad we clarified that - NiceNSmooth"

"Guess you are going to let him kill someone else, huh? - msha"

For clarity's sake, the person in question was accused of killing one person, and now those charges have been dropped. No one was killed in the other crimes.

  • anne53ozzy Feb 22, 2013

Whatever we think..this is always about the family when it gets to this point. It is clear that a resolution has been met.
Time to move on and give the family peace on this terrible issue

  • Good Bye WRAL Feb 22, 2013

If criminals and thieves are to be believed, then dropping these particular charges may be reasonable. I have to assume that criminals share certain tools such as guns and Lovette had this one while murdering Mohato and perhaps Oates was robbing someone elsewhere that day? Either way, Mohato's family has not seen much justice so far!

  • anne53ozzy Feb 22, 2013

I can't help but think that this has to do with the fact that Eve was and is a beautiful white young woman and that the death of this young man, shot as I understnd between his eyes, is less a concern.
I understand...but I do not at the same time.

  • charleswells58 Feb 22, 2013

Why anyone would go to school or live in Durham with the justice system they run is beyond me

  • djofraleigh Feb 22, 2013

Had they been on it, Lovette would have been locked up before he could have hurt her. COMMENT

That's a casual statement which needs facts. The Duke murder did have police on it but no leads. Had this man's crimes been solved before either Mahato or Carson's murders (with the same gun this man used in prior robberies, shooting people in the legs) then neither murder might have happened.

Mahato & Carson died horribly, without resisting, pleading and trying to live.

The killers are in heated & air conditioned jails, watching TV, eating well, socializing, lifting weights, communicating with friends and family on the outside. They smile and laugh and will live a long time. They are confined to keep them away from us, but they are not yet rotting in the cold ground. That's justice as it is.

  • mike275132 Feb 22, 2013

And so it goes for the The Durham Police Dept

    Durham ...

  • djofraleigh Feb 22, 2013

Amazing how hard it is to prosecute criminals, how hard we try to give criminality their rights, and how easy it still is to convict the wrong person.

Amazing too, is how easily, quickly we forget the innocent victims of crimes. Eve Carson is remembered better than others due to her many recorded events and easy name, but Mahato, Abhitiit Mahato is never mentioned in conversations. Both of those innocent victims would have gone on to make this a better world, I think, and as Darwin's law dictates, survival is the victor.

"Has he been in jail since he was arrested in 2008?????????

If he has, he'll be due a check from the State for some serious spending money." - beachboater

He has been locked up in jail on all those other charges. You know - all those people he shot in the legs while robbing them.

  • UNCfuturealumi Feb 22, 2013

Where is our justice system thinking? What is happening that all these people charged with these hidous crimes and then set free, such as the case with the man who just shot the police officer in Durham..just do not understand

  • nothing surprising Feb 22, 2013

bmac13 - What does Eve Carson's death have to do with Oates or Abhijit Mahato's death? The only person connected to both is Lovette.
The story of Mahato's murder was so insignificant until Eve Carson was murdered. Had they been on it, Lovette would have been locked up before he could have hurt her.

  • ripetomatoes Feb 22, 2013

Occasionally I read about the death penalty not being a deterrent in preventing this type of crime.
I am 100% sure it is effective concerning repeating offenders.

  • anne53ozzy Feb 22, 2013

Guess the evidence does not support further actions on this count
Only can hope that he is put away forever on other counts

And hope this may be because the families want peace

Lets not forget the other charges. Armed robbery and shooting people in the process. I think he has enough to worry about with stressing about his financial gains right now!

  • bmac813 Feb 22, 2013

computer trainer, He is not getting out of Jail,He will not be back out on the Street.

  • aetius476 Feb 22, 2013

Looks like Mr. Mahato will get little, if any justice. I guess being a foreign student makes your life of little value.

The "usual suspects" that killed him will be allowed to continue their murderous ways with little inconvenience.

We are asked by the left to surrender our personal protection weapons at the same time the home invasions, killings, and rapes are rampant, and the court system recycles the perpetrators like tin cans...

  • computer trainer Feb 22, 2013

The dismissal means that Laurence Alvin Lovette Jr. is the only person charged in Mahato's death.--- BUT, he was too young to know what he was doing at the time, he had such a rough life. SO, timeout for Lovette and back out on the streets to reek havoc on more lives.

Now we have to Feed him for the Rest of his Life.
One good thing about that Case, Eve Carson is with the Lord.
