    jcthai, my pojnt is if he can be rahabilitated, that's good for him, but it should be affect a sentence, even if a judge can consider it. If he can be rehabilitated, that will help him wit this maker when he dies. His debt to society and the victim's family should not be considered repaid until his own death.

    Exactly. Everyone relax, at least until he is resentenced. I seriously doubt he will be getting out anytime soon. EVEN IF he would come up for parole, he would still have to pass the parole boards review. Charles Manson has come up for parole how many times and is still in prison?

    The guy executed a person on her knees. The distinction of a 17 yo not being fully responsible and an 18yo being fully responsible is absurd and arbitrary. 17 year olds are responsible enough to drive a car but aren't capable of grasping the concept of what it means to kidnap someone and execute them on there knees at the edge of a road? Absurd.

    Hope he is once again sentenced to life without parole. This court decision, as I read it, doesn't mean that he can't be sentenced this way, only that it is not automatic.

    It would do no good to give him the death penalty since there is still a stay on executions here in NC . I agree with rednek that the ultimate penalty should have been given to both of these lowlifes . They kidnapped her , stole her SUV ,and shot her with a handgun and to " finish her off " , they used a shotgun . Rehab for a mentality like that ? No , they both should never see freedom for as long as they live .

    in some cases, the potential for rehabilitation shouldn't be a factor in sentencing. this is one of those cases. the difference is punishment vs. keeping a dangerous person off the streets. he should be punished for the rest of his life.

    readme, the point about rehabilitation is that if there is any chance of it, you might give a lighter sentence or allow the possibility of parole. But that is why the judge has the discretion to say that if there is no chance, the sentence is still life without parole.

    Agree with you. He should have gotten life, regardless of his age. He knew what he was doing was wrong. The late Ms. Carson lost her life for nothing because of these two men.

    WRONG!! WRONG!! WRONG!! If this guy is old enough to shoot her in the face with a shotgun after robbing her at her ATM, he's old enough to face the consequences. This has nothing to do with the color of his skin or his apptitude. It has to do with his finder pulling a trigger and blowing away a woman who had the whole world at her fingertips.

    Before long, you guys will be giving 5 year and 10 year sentences for murder. YOU ARE REDUCING THE VALUE OF HUMAN LIFE!!! This guy should have been on death row!!

    "Rehabilitiation." That word infuriates me. Prison time should serve a punitive purpose first. Rehabilitation is good if it happens, but if not, oh well. Let him rot in his jail cell. If this kid had any honor at all he would take his own life.

    So, he's getting a second chance sentencing? What happend to giving Eve Carson her chance to live her life. He knew what he was doing .... only thing is is that he thought he'd get away with it. He and his accomplice took the life of a young woman who had her whole life ahead of her and by her track record she would have gone far in her life. Now, we'll never know. It's sickening that this scum is even shown the light of day and even gets a chance to be resentenced. Our Judicial system ant those who come up with these kind of laws should be proud.....NOT. Absolutely sickening.....

    He has killed 2 people and doesnt deserve life w/o parole - you are right he does not - he deserves the death penalty - the 2 people he killed did not get a second chance. Even the death penalty really means life - what a juddicial system we have!!

    So let me get this straight. He murdered that poor girl in cold blood but because he was 17 he now stands a chance of getting out on parole after he serves what 20 or 25 years?? So that means he could be free to roam our streets when he's say 40 or so?? Where is the justice in that?? I and quite a few others feel he should have recieved the death penalty for what he did!!!

    If you are 17 today and 18 tomorrow,does that mean that tomorrow your ability to be rehabilitated has improved and your immaturity has improved to maturity . Does a day or a year make a difference? At what age does a person know right from wrong? Don't make much sense but very interesting.
