This situation is NOT just confined to Los Tres in Cary. There are other restaurants owned by "Caucasian Americans" that pay under the table to avoid paying payroll taxes. All restaurants should be inspected not just for "health" purposes but to make sure they are treating the employees fairly.

evababy305...try using a comma or period every now and then

The consistantly win for the best Mexican food in Western Wake County year after year. My children and I have been eating at their restaurant on Kildaire Farms road since they opened about 20 years ago. And we'll continue to eat there. The worst thing would be to boycott them and have all those innocent, hard working people losing their jobs.

  • susjomiller2 Feb 15, 1:34 p.m.

Cannot wait to eat there... Lighten up folks... If we boycotted everyone who ever made a mistake (could easily have been a misinterpretation of the law), we would all eat at home.... Oh wait....some of the grocery stores we buy food at might have also erred...better grow our own....

"I will never eat at this Los Tres again."
    Back in the saddle again

To be safe, you better not ever eat out anywhere again.

So much for my $.99 Margaritas...The government steps in and screws everything up again.

Why doesn't the media put what good this restaurant does for the local high school the catholic church and the orphanage in mexico typical that they would only get the negative thing about this business and also I don't think the servers were getting pay bad I've gotten to know the majority of them and they have nice cars and they have told me about remodeling made to there homes soo I hate that they would do this to this business and fine them soo much i will still be going to eat there as long as they keep making great food and great service i will still be going

"This isn't the same owners as the one under same name in Fuquay Varina. Great food there too and hopefully they are paying their staff properly!" - whocanitbe123

I love the one in Fuquay. Great food, great price, great service.

I think the important thing to take from this article is "illegal"...who else would work for 3 bucks an hour...

Back in the saddle again...I'm with you except if folks stop eating there, then we'll have a negative affect on the employment of those same folks, but at the same time we'll be lining the pockets of the greedy owners if we eat there.

  • EnoughWhiningAlready Feb 12, 6:24 p.m.

This had to have been going on for months and months and months for them to owe 145K in back pay to their employees. Shame on them!

  • lmatthews1948 Feb 12, 6:15 p.m.

This probably covers missing wages for 3 years only. Part of this is normally a penalty that will not go to the employees. I really enjoy their food. It is always fresh and the servers are quick and efficient. Many restaurants pool tips collected and divide it with the kitchen help. I didn't realize this was a violation.

My assumption is that a restaurant like this normally nets between 5-10% profit after all expenses and taxes. If that is the case, they need to produce $1.45-$2.9 million in sales to recover the payment for this error in judgment. These guys knew better but I would hate to see it go out of business. I will eat there again next week just to show my support and help keep those workers employed.

Closing them down puts everyone on unemployment. The workers can't afford that.

  • beach2011 Feb 12, 3:29 p.m.

Close them down!! Never eat there again.

  • LuvLivingInCary Feb 12, 3:28 p.m.

so now i'm off to mexico without paying anyone....

  • JustAName Feb 12, 2:57 p.m.

    Well, the food was good.

Road-wearier, they'll just be taxed at the Democrat income tax rate, if you were wondering.

  • itsnotmeiswear Feb 12, 2:55 p.m.

It should not take them long to find another one doing the same thing. I would say about this is a problem with about 50% or more of restaurants particularly ones with mostly illegal work forces.

  • NoObamaCare Feb 12, 2:46 p.m.

Wondering if this will hinder the "New" restaurant they planned on opening at Cross Roads near Mitchell Mill?
