Homeowners should have the right to protect their home and family from this type of evil when it comes to their door. We know the real story here and why he spent one day in jail.

  • beach2011 Feb 12, 2013

So glad he is getting out - but sad that his wife, who just died of breast cancer, will not see it. She faught for him and she is the reason he is being released!!

  • SingleLensReflex.SLR Feb 12, 2013

sounds like a tragedy for John McNeil and for his family. Thank heavens McNeil's son will have him now that McNeil's wife has passed. Her spirit will be glad.

  • gabewilliams12 Feb 12, 2013

This is such a sad story. His wife fought for his life and she lost hers. He will live forever knowing that his wife fought so hard for him. Good luck sir.

  • whatever02 Feb 12, 2013

He did call 911. He also fired a warning shot into the gound. The guy kept coming after having put something in his pocket from iside his truck after threatening John's son with a box cutter. Neighbors confirmed his story, the police testified on his behalf. If someone comes to my home threatening my kid and threatening me with an unknown weapon, I would do the same. I normally think the NAACP overreacts and stirs the pot - I am glad they are involved in this (except for Anita's funeral - they had no place there).

This sort of thing seems to happen pretty often in Georgia. It's ridiculous that this man has spent a single day in prison.

  • smcallah Feb 12, 2013

"For shooting a man dead who refused to leave his front yard?

Why no call to 911, why not go into your house and lock the door? Why not run for help? Shooting a neighbor dead outside in your front yard?"

You and your family shouldn't have to turn your back on a madman on your property that is threatening you with a knife. He chose to come to your house and if you have the means to defend yourself you should be able to chose that option.

The man with the gun didn't start the altercation, as the witnesses said. The home owner with the gun did not go looking for a fight.

If you want to live, don't go to someone's house and threaten them with a weapon.

My sister went to college in Kennesaw and remembers when this happened. According to the local papers, the man had a history of threatening the McNeils and had confronted them numerous times. On the night he was killed, he was making a lot of threatening gestures with the box cutter, and was threatening to follow the family into the home. I don't know if this is truly what happened, but if so, I'd have shot him dead, too.

  • RM24 Feb 12, 2013

Aetius476: I mean I guess he could have just shot himself and handed his son over to the man who wanted to harm his son too.

  • delilahk2000 Feb 12, 2013

ONE MORE THING.....THESE DA'S NEED TO BE HELD ACCOUNTABLE FOR THE WRONGS THEY DO JUST TO WIN A CASE.........A LOT OF THEM NEEDS TO BE IN PRISON.....

THE NAACP TURNED THAT LADIES FUNERAL INTO A MEADIA CIRCUS JUST TO HAVE HIS FACE IN THE NEWS AGAIN. HE COULD CARE LESS ABOUT THESE PEOPLE THAT HE PRETENDS TO HELP.......IT IS ALL ABOUT HIM AND THE SO CALLED GLORY HE HAS.....HE NEEDS TO GO INTO THE NEIGHBORHOODS AND PRMOTE ED. AND HOW TO SUPPORT YOURSELVES AND STOP DEPENDING ON US TAXPAYERS......BUT NO.....THAT WOULD BE AN ACTUAL JOB FOR HIM TO DO INSTEAD OF CRYING RACE ALL THE TIME.....MR BARBER THAT IS GETTING VERY VERY OLD......YOU SOUND LIKE A BROKEN RECORD THAT NEEDS TO BE TOSSED OUT.....

  • 75Tarheel Feb 12, 2013

He is, in fact, guilty of voluntary manslaughter. He did not have to retreat, call for help, or run to a neighbors house. That's his decision. His mistake was bringing a gun to a knife fight and then killing the suspect.

Your right to use deadly force is limited to being threatened with deadly force. Unless the suspect had Mr. McNeill's son by the arm with the knife at his throat then deadly force would have applied. However, if the suspect was only on the property threatening the son and farther than an arms length away deadly force was not appropriate. Therefore you had Mr. McNeill prosecuted for 2nd degree murder and convicted of same.

In my view, he's served his time and should be released.

What does this have to do with Libs? Your Republican good 'ole boys are the reason this man is in prison.
    Obamacare rises

How many conservatives do you know would back the law that was mentioned in the article. That is a pansy liberal law. You should be able to defend you family and your property from anyone that threatens.

  • firecaptain2000 Feb 12, 2013

Thank God for an honest judge who stepped up and righted what appears to have been a “Nifong”.

I'd like to be the first "white man" to offer him a ride home. At the very least does anyone know if there is a fund set up to help this guy get back on his feet?

  • wildpig777 Feb 12, 2013

the real enemy is the legal system, as long as people can be diverted by arguing about race-- the legal system is not held accountable for it's mis-use, corruption, and abuse of power.

for decades now the people have allowed this monster {the legal system} to run rough shod over our rights and liberties to the point that lawyers and judges now are convinced THEY OWN AND RUN THIS NATION.

  • wildpig777 Feb 12, 2013

i suspect that John Mc neils bullets ---like mine -- ARE COLOR BLIND. i will shoot you in a skinny minute if you're on my land threatening my child with a box cutter and refusing to leave.

thats my idea of gun control-- color blind bullets and hitting what you aim at. btw -- i'm not white i'm not black -- i know ALL YOU BLACK AND WHITE BIGOTS HATE WHAT I'M ABOUT TO SAY -- I'M HUMAN.

  • heelsgirl05 Feb 12, 2013

plead guilty to manslaughter for a killing in self defense? are you KIDDING ME? This guy will never be able to get a good job again because of some dumb judge and DA. They can't handle the fact that he will be set free so they still want to leave their mark on his record!

  • gammasandi Feb 12, 2013

this is not a forum to blame Republicans for this man's arrest, nor to disparage liberals...the facts should speak for themselves: if he was threatened on his own property by someone who refused to leave, why is he in prison? Citizens, take note: this can happen to anyone...it is so sad that this man and his family have had to endure such a travesty...btw, I am white, conservative and Christian...

  • Canes Girl Forever Feb 12, 2013

I hope they set him free. I am sorry he missed the final years with his wife.

first off, I am not a fan of every incident being racial if it contains different races...people actually make decisions not based on race. Secondly, if the facts of the article are true then...well....survival of the fittest the guy should have had better sense. Maybe we should offer common sense classes for free....first lesson, don't bring a knife to a gun fight.

  • SouthernPackerFan Feb 12, 2013

we all know why he was in jail , now don't we

"John McNeil and his family were the only black residents living in an upscale suburban Atlanta neighborhood in 2005 when he shot and killed a white man on his property.

Witnesses corroborated McNeil's story that the man had threatened McNeil's son with a knife and refused to leave the property even after McNeil fired a warning shot into the ground

  • SouthernPackerFan Feb 12, 2013

  • Obamacare rises Feb 12, 2013

This man should be freed. What a travesty this whole thing is.

  • sendusmessage Feb 12, 2013

This is still wrong. How is he still charged with manslaughter, defending his family against an armed aggressor trespassing on his own property??? Someone needs to sue Cobb county and that DA for this injustice.

  • justaconservativeguy Feb 12, 2013

The state law previously required homeowners to show they had tried to retreat before using deadly force in order to claim self-defense.

How insane is that. You were required to show you had retreated in order to be able to use deadly force. This man protects himself and his family from a criminal and he gets put in prison. Go ahead libs, can wait to hear how you all defend this one. I know it is racism..... that man should be set free. Such a shame.
