    A few questions:
    1. who is paying for the storage of the remains? The state? The family? The defense?
    2. would 'nt the medical examiner's report cover this?
    3. If the defense needed extra tests should 'nt these be done without delay?
    4. How far have we fallen as a society when we do not even allow a family to bury the dead in a timely respectable manner?

  • jhk0704 Oct 5, 11:45 a.m.

Judge Hudson didnt open the door. He granted a defense motion to preserve the body and % DAYS LATER Cline knowing this allowed the body to be released and creamated. Hudson did what he had to. I dont agree with it but the alternative of allowing the prosecution to9 destroy the body before it is examined is A WHOLE LOT MORE FRIGHTENING!!!!

  • jhk0704 Oct 5, 11:43 a.m.

I know it is a awful thing...but legally its the right decision. The defense has the right to examine the body. Just be glad this isnt Durham or the DA would allow it to be creamated and the case would get thrown out. Praying for the family through this whole ordeal. What a tragedy. I know its hard but just let the legal process take its course and those 4 heartless criminals will get convicted and sent away forever like they should!

As horrid as waiting may be for the family and friends of Kennedy McLaurin, the worst has already happened; he has been stolen from them, and they must deal with this loss for the rest of their lives. My best thoughts are with them.

If there are any tests that can reveal more about how he was murdered and by whom, then, as annoying as it may be, ultimately it is better for the tests to be done.

Sadly enough, there will be sorrow enough to last for years.

  • PracticalMagick Oct 5, 11:02 a.m.

This is atrocious; hasn't this family suffered enough, and now they have to put off his burial to "assist" the legal team defending their son's murderers? Unbelievable. ~~larterl

    EXACTLY! Thank you!

  • Fireflies Rock Oct 5, 10:24 a.m.

Any necessary further testing needs to be done IMMEDIATELY, so the body can be released to the family. This is atrocious; hasn't this family suffered enough, and now they have to put off his burial to "assist" the legal team defending their son's murderers? Unbelievable.

"And to the joker(s) who are making the inappropriate comments, Karma's a you know what, but I hope you never have to read comments like that should you lose a loved one.
    PracticalMagick"

At least in our instance that is not likely to happen. We are not into obsessing over dead bodies. We would rather obsess over the living. After death our corpses go to the nearest medical school where they can be put to good use.

  • PracticalMagick Oct 5, 9:05 a.m.

Just get the testing done ASAP, return his remains to the family and let them finally start to heal.

And to the joker(s) who are making the inappropriate comments, Karma's a you know what, but I hope you never have to read comments like that should you lose a loved one.

  • westernwake1 Oct 4, 7:56 p.m.

This is very sad for the family. Hopefully this delay will ensure that the murderers do not escape conviction for their crime.

  • piene2 Oct 4, 6:01 p.m.

"This is ridiculous in my opinion. An autopsy should suffice. I feel sorry for this family."

Last month everyone was screeching at the top of their lungs because a body was not available for further testing and now everyone is screeching at the top of their lungs because it is being retained. Please make up your collective minds. You are giving me a headache with all that screeching.

  • Sherlock Oct 4, 5:52 p.m.

The defense team need to pay the family for the cost of the burial and if the do not pay then sue the lawyers individualy.

  • piknowles4 Oct 4, 5:30 p.m.

    Let Theo go!

  • oleguy Oct 4, 5:04 p.m.

Our court system is a joke,,, Too many lawyers, too liberal, Perform the test and give the body to the family,,,

  • BobLoblaw Oct 4, 4:54 p.m.

Geez - that is awful. Thoughts and prayers for the family.

Yet another defense attorney argument designed to thwart, delay, and obstruct regardless of cost or effect.

  • kimsstressed Oct 4, 4:35 p.m.

My sympathy goes out to the family. They will not be able to start the healing process until this young man is laid to rest. I hope it will be soon.

  • mfarmer1 Oct 4, 4:23 p.m.

If I was the judge I would have asked what tests, and then ordered the test to be done all within 5 mins. If the defence don't know what they want I would have given them 1 hour to figure it out.

there is nothing wrong with the defence trying there hardest to find the truth, but to just delay this forever is not the way to go.

they certainly are not trying to make friends with the family, prosecution, the public, and the potential jurors.

  • Obamacare prevails Oct 4, 4:19 p.m.

do you not have anything else to say besides looking like an DA
    Whatever Geez

    I love irony. ;)

  • Strong31 Oct 4, 3:55 p.m.

Okay maybe it is just me, but does the statement "Arnold said Thursday that he will revisit his ruling after the final autopsy report is complete and DNA test results in the case are available" imply that this young man's body has not been positively identified yet through DNA or does it imply that more DNA tests need to be done to link the men to this crime?

I'm a little confused by this.

  • tierneemalinadeveaux Oct 4, 3:55 p.m.

This is so unfair to this family. I cannot believe how inconsiderate this judge is.

  • LordHelpUsAll Oct 4, 3:48 p.m.

His earrings? Really? That's just cold and unnecessary.

  • Whatever Geez Oct 4, 3:47 p.m.

that is just wrong....do you not have anything else to say besides looking like an DA

  • sykesmelissa99 Oct 4, 3:45 p.m.

I know that this has to be difficult for this poor family! I am praying for this family, and that closure can happen soon for them. This is such a tragedy, the loss of such a young life.

  • APXmom Oct 4, 3:44 p.m.

    to:Obamacare prevails
Insensitive, ignorant inappropriate and childish. This a young life lost and a grieving family. how dare you!

  • buford Oct 4, 3:41 p.m.

@Obamacare prevails - I see you changed your screen name...but your ignorance hasn't changed a bit...

  • RomneyRyan2012 Oct 4, 3:30 p.m.

You're sick Obamacare prevails...absolutely disgusting. THese are the kind of comments that shouldn't be printed. Unfortunately, you are protected by Freedom of Speech.

  • charmcclainlovesdogs2 Oct 4, 3:23 p.m.

    recover his earrings?

Were they real or fake? If fake, then it will not matter.

  • charmcclainlovesdogs2 Oct 4, 2:49 p.m.

This makes it hard for the family. But yet they do need all the evidence to keep these guys locked up for life.

  • RomneyRyan2012 Oct 4, 2:46 p.m.

    Do they suspect something??

  • sjb2k1 Oct 4, 2:16 p.m.

maybe i'm reading this completely wrong but how is a dead body not human remains? or is that just Durham's DA's office trying to un-F what they F-d?

  • storchheim Oct 4, 2:10 p.m.

I thought so too, Heavenly. Now that all have been arrested, what reason is there to hide the motive?

  • 12-21-12 Oct 4, 1:54 p.m.

this is just torturing the family again.

  • uncw05 Oct 4, 1:39 p.m.

thepeopleschamp- seems like they should be able to bury, just not cremate. After all, bodies are exhumed for further examination all the time.

  • thepeopleschamp Oct 4, 1:38 p.m.

Judge Hudson has now opened a door where defense lawyers can now say 1 day after any murder victim is buried "Ohh yeah, I wanted to examine the body myself". Families should not be required to wait to see what a murder suspect's lawyer wants done with their family member's body. This creates a situation where the murder defendant and his lawyer controll the victim's burial. Outrageous.

  • Glock07 Oct 4, 1:38 p.m.

We can all thank Orlando Hudson for this nonsense. He created this mess.

  • thepeopleschamp Oct 4, 1:34 p.m.

This exactly what predicted would happen when I saw the Durham judge's ruling. Murder victims are not to be buried so defense lawyers can stall and send in "their own" examiners? This is insane. What if there is no suspect in a murder right away, are familes to wait for years before burial in some cases? Thanks again judge hudson, you've outdone yourself this time.

  • carolinej Oct 4, 1:33 p.m.

This is ridiculous in my opinion. An autopsy should suffice. I feel sorry for this family.

  • dontstopnow Oct 4, 1:24 p.m.

Kind of strange they still will not release the details of WHY this kid was murdered. Sure they know by now since the autopsy is completed. They have not even told what caused his death much less why in the world these boys did it. No excuse is good enough to take a live, but a story like this leaves to much information out.
