— A registered sex offender is under investigation for child abuse and faces charges that he violated his probation, according to the Cumberland County Sheriff's Office.

Investigators said that Lenell Douglas Smith, 39, was living in his girlfriend's home in the 6200 block of Stoney Point Loop, which is 760 feet from a licensed daycare center. Investigators said Marcia Cox Woodard, 43, was aware that her boyfriend is a registered sex offender.

Authorities most recently verified Smith as living at 6312 Milton Drive in Fayetteville in May, according to the North Carolina Sex Offender Registry.

Investigators said that Smith is also a suspect in a possible case of child abuse that occurred in Woodard's home that came to authorities' attention on July 7. Details of that case weren't released.

Smith was charged Wednesday with failure to change his address with the sex offender registry and living within 1,000 feet of a daycare center. He was given a $51,000 secured bond and scheduled to appear in court July 21.

Woodard was charged with failure to notify law enforcement of a sex offender registry violation. She has been released under a $5,000 bond.

Fayetteville police charged Smith with statutory rape involving a 15-year-old and taking indecent liberties with a minor in May 2004, investigators said.

He was convicted of attempted indecent liberties with a minor, given a split sentence and served 1½ years in prison, according to state Department of Correction records. He served an additional 16 months for violating his probation.

Smith also has convictions for assault on a female and drug dealing, DOC records state.

I still don't get the distance thing with schools and daycare b/c after we purchase our home is when we found out that a sex offender lived next door! I can't make him move to protect my children all my husband and I can do is let him know he is not welcome to cross our property line. I say once their convicted lets just send them to a remote island together.

He's already been charged with other crimes, I'm not sure what living near a daycare has to do with that. Was he sitting outside with binoculars and candy? Highly doubtful.

There is a difference between "crimes" and Crimes, rape is a crime, the difference between living 999 or 1001 feet from a daycare shouldnt be a punishable offense. Who is that really protecting? Not MY child!

Looks like WRAL updated the story. As usual, they publish something incomplete.

"I guess he forgot to take out his measuring tape to see if he was far enough out. I wonder if he knew there was a daycare there. I wonder if SHE even knew about the provision in the law. tar97heel"

I really have to question why you would side with a rapist. Lack of character? If your a sex offender make sure you don't forget your tape measure. If your shacking up with a sex offender , why I don't know, make sure you know the laws pertaining to them.

tar97heel- if you had/have children, would you want to know if a sex offender lived in the area of your home or your child's day care? I'm curious.

The only people who wouldn't want to know if a sex offender was living in their neighborhood is sex offenders. With that being said, I'm curious too....

"did YOU read the article. It says the man is a suspect in a case of child abuse that occured July 7. That is one week ago. Sounds like he was doing more than "minding his own business"." -

Iconoclast, FUNNY - i was getting ready to say the SAME thing. I guess tar97heel missed the all of the "Fayetteville police charged Smith with statutory rape involving a 15-year-old and taking indecent liberties" lines. Wowzers....

What good does it do to know if a reg sex offender lives near a day care? Are the kids roaming the neighborhood? No, it's a daycare, hell parents have trouble getting to see their kid without proper ID how exactly does anyone living in the neighborhood factor into this. This law was enacted by some busybody overprotective soccer mom with influence over our elected officials.
