Ruling: No just cause to fire former state Capitol police chief

An administrative law judge in Wake County says the former chief of the State Capitol Police should get back his job.

RALEIGH, N.C. — An administrative law judge in Wake County says the former chief of the State Capitol Police should get back his job.

In February 2013, Tony Asion was one of two officers dismissed after an investigation into their off-duty work.

Asion appealed his termination, and after a hearing, Judge Donald Overby ruled this month that there wasn't just cause to dismiss Asion.

Suspension without pay or a demotion, Overby said, would have been appropriate.

Asion, who now works in the private sector, says he only wants to clear his name of any wrongdoing.
