Prosecutors drop charges against man in 2-year-old's death

DURHAM, N.C. — Prosecutors in Durham County say they have dropped the charges against a man who served 12 years in prison for the death of his then-girlfriend's 2-year-old daughter.
WRAL in Raleigh reports (http://bit.ly/2fIFEXM) the Durham County District Attorney's Office dismissed the charges against Derrick Michael Allen. On a dismissal form filed in late October, Assistant District Attorney Luke Bumm wrote that witnesses essential to the case either cannot be located or are not cooperating with prosecutors.
Superior Court Judge Orlando Hudson threw out the charges in December 2010, saying prosecutors hid evidence and the State Bureau of Investigation's crime laboratory intentionally omitted evidence about blood tests in Allen's case.
The state Court of Appeals overturned Hudson's decision in September 2012, saying it didn't see his reasoning for throwing out the charges.
