Off-duty officer steps into dispute, kills man in shootout

— Detectives are investigating a dispute that escalated into an off-duty North Carolina police officer and a restaurant patron exchanging gunfire that led to the civilian's death.

Multiple media organizations reported the shooting happened around midnight in the parking lot of a Buffalo Wild Wings restaurant in Greenville. Tsombe Jashon Clark, 25, of Robersonville, died later Saturday, police spokeswoman Kristen Hunter said.

Officials say Officer Gary Barrett was picking up a carry-out order at the restaurant when he was asked to stop a fight involving several people that started inside and spilled into the parking lot.

Barrett identified himself to people involved, but one man pointed a gun and fired. The officer then returned fire.

The State Bureau of Investigation is on the case because it involves a law officer.

Barrett is a 20-year veteran of the Greenville Police Department and is currently assigned to the motorcycle unit.

    ... but.. but.. but BWW is a gun free zone!! How did this happen? Why didn't the person obey the sign? THAT'S ILLEGAL!! We *must* have a *new* law because the current law didn't work! If it saves just one child!!

    Was the officer white and was the man shot black? That question probably jumped up in people's minds. Should it have? And if so, should it prejudice our thoughts?

    A man already upset, already fighting, probably drinking, probably in front of an audience, is already out of control, is faced with someone sworn to take control and bring peace and order, that man might make a stupid move and become murderous, especially if he thinks he is going to be arrested or has other warrants out. It was a fatal decision. The one the dea man was fighting with was in mortal danger. Wonder if he knew the man was armed.

    I know it's stressful when they run out of wings but you don't have to start a fight and shoot at the police.

    Moral of the story....DON'T shoot at a cop (on or off duty) unless prepared for the consequences....
