A Durham businessman has been accused of tax fraud by the North Carolina Department of Revenue.

Tyrone Tyree Irby, 45, of 5150 Revere Road, faces six counts of willful failure to file return, supply information or pay tax.

Revenue department investigators believe that Irby failed to file and pay his tax returns from 2004 to 2009, department spokeswoman Beth Stevenson stated.

Irby is listed as the owner of Choice Personal Fitness and Up in Smoke Catering on the companies' website.

He was placed in the Wake County jail Thursday under a $10,000 secured bond. His first court appearance was set for March 7.

@fatchance, the guy created and ran two different businesses for several years. Maybe he’s broke and desperate. C’mon...we all know why you assume he’s uneducated... In any case, our jails of full of smart & educated people.

@hereandnow99: Uneducated as in not posessing sufficient knowledge of how to run a business properly and within the law.

Uneducated as in not posessing the common sense to know that not paying his taxes would ruin his business.

Uneducated as in not posessing sufficient knowledge of the tax laws and repercussions of violating them.

Oh, were you talking about his highschool or college education level? I wasn't. Funny how you can assume something incorrectly, huh.

hereandnow99: It's just a guess.

@fatchance, how do you know about this man's education level? Some people don’t pay taxes because they’re making a political statement.

This is what happens when uneducated folk try to go into business.
