Judge rules that Fayetteville can annex community

A Cumberland County Superior Court judge granted a motion on Thursday that effectively ended a gated community’s challenge to a proposed annexation, officials said.

Fayetteville City Council members voted last October to annex the Gates Four Golf and Country Club. The community has opposed this decision for the past five years.

Residents of the 600-home community won a temporary stay from annexation when they fought a city plan in 2004.

On Thursday, a judge granted the city’s motion for a summary judgment.

Councilman Charles Evans said the community can appeal to the state Court of Appeals. There is no word on if the community is planning an appeal.

The annexation is scheduled to take place on Sunday, Nov. 22.

I tend to agree that the laws need to be changed. BUT this neighborhood agreed to drop their suit back in 04 knowing they would annexed in in 09, now when its time to be annexed they want to fight back again, they got what they deserved and agreed too!!

The Annexation laws in this State need to be changed. Nothing is more outrageous to me then these cities basically seizing property over the objections of people that had no vote on the people that are doing the seizing. Americans need to really push back hard on the ever increasing Fascist tendencies of our Government entities.

Just more city tax money from people who have no desire to live in fayetteville. If they wanted to live in the city, perhaps they would have moved there in the first place instead of outside the city's limits
