Troopers in Johnston County said no charges have been filed against the driver who hit  Kenneth Alan Neumyer Jr., 36, of 408 Godwin St. in Selma, early Wednesday.

Neumyer had been drinking and passed out in the road,  troopers said. Walter Brown Hall III, 56, of Raleigh was driving an SUV when he hit Neumyer at 923 Crocker St. around 2:30 a.m.

Hall told authorities the victim was lying in the street.

Thank you Ken's nephew for sharing this. I have known Ken for the last year or so and I will miss him. Comments such as the previous ones come when news agencies publish reports based on assumptions and not facts.

He was my Uncle and the whole story has not been released. We received the autopsy a little while ago and it shows that he was hit twice. The first time was a hit and run which explains why he was lying in the street when the second car came. This case has now been moved to Homicide and my uncle was found not to be at fault. To set the record straight he was not just aimlessly walking around the streets. He went out with some friends for his day off and instead of driving after he had a few drinks he decided to walk home as not to harm anyone else. Who knew that he was the one who was going to be harmed on a night where he was thinking about the safety of others. RIP uncle Kenny

Did I say all situations? No. Fools

"Drunk people lay in the road like this because as the air gets cooler at night the road is still warm from the days sunlight. They lay down to get warm."

you have got to be kidding me! he passed out because he was too drunk, not to get warm. is this a common problem? people laying in the road to get warm at night? get a blanket! thanks for being a darwin awards winner!

I love all the experts on 'swerving' - One blanket statement stated by an 'expert' to cover all situations. like it doesn't matter if you are driving a Porche or a clunky old SUV. Sorry, but that ain't how this works. Every situation is different, vehicles are different, roads are different, and drivers react differently. Yeh, I am an expert too.
