The Moore County Sheriff's Office charged a 17-year-old man with raping and assaulting a 37-year-old woman in the Carolina Lakes subdivision New Year's Eve.

Deputies arrested Jordan Nathaniel Mitchell, of 145 Heron Road, and charged him with second-degree rape, second-degree kidnapping and assault by strangulation.

An EMS crew took the victim to First Health Moore Regional emergency room, where she was treated for her injuries and released.

Mitchell was being held in the Moore County Jail under a $200,000 bond Friday. His first court appearance was scheduled for Jan. 12.

Mitchell was twice sentenced to probation in 2008, according to state Department of Correction records. He was convicted of carrying a weapon on state property in Hoke County in May and of misdemeanor breaking-and-entering in Moore County in November.

Wow, what a difference in responses between this story and the one from a few days ago about the 16 yr old white kid charged with raping a 13 yr old girl. Nobody yet has mentioned WRAL posting the picture of a minor who has only been charged, not yet convicted. I myself commented about that on the other story. Also, no comments here about "innocent until proven guilty" or the fact that the victim could be not telling the truth. I myself commented on such on the other story. I'm supposing the difference in attitudes is the fact that this guy has a past criminal record. Or could it be that he is black and the other kid is white? They are only a year apart in age and both minors. Could the age of the victim make some difference? Just curious about the differences in reactions to the two stories. fatchanceimwrong

WHY is it always about race??????? get over YOUR racism and get a life!!!!

fatchanceimwrong, I hate to burst your bubble this morning and tell you that YOU ARE WRONG. The kids in the article from last week about the rape in Hollister WERE NOT WHITE. They are of native american descent. If my memory serves me correct I heard most of those involved even the building owner and party host are of natie american descent. So don't assume that everything is black and white, becasue when you assume - - we know what that means.

What is second degree rape? Is it less violent than 1st degree rape?

hey leo if im not mistaken didn't they make choking a woman a felony in the last 4 or 5 years? I think it was directed at preventing spousal abuse but i think it would apply nicely here as well if im correct.

"If this guy forcibly entered the home and forcibly raped this woman why is it not 1st degree rape? He should be looking at life without parole for this. Maybe when all the evidence is in they will charge him with 1st degree rape and lock him up forever."--

The crime he committed most likely didn't meet the element requirements for 1st deg rape. Which is raping while using a deadly weapon, or inflicting SERIOUS bodily injury or being aided and abetted by one or more persons.
