Paddock's attorney files motion to supress statements to police

Lawyers for a woman accused of killing her 4-year-old adopted son have filed a motion to suppress statements she made in police custody prior to being read her rights.

Lynn Paddock is charged with the Feb. 26, 2006, death of her 4-year-old adopted son, Sean. Investigators said she wrapped Sean so tightly in a blanket that he suffocated.

Paddock's attorney insists the death was accidental, not punishment or discipline. Her trial is scheduled to begin this month.

Prosecutors decided not to press charges against Johnny Paddock, Sean's adoptive father.

In motions filed Wednesday, attorney Michael J. Reece said Lynn Paddock was taken into custody and interrogated without being read her Miranda rights.

The motion said she made “certain statements to law enforcement officers” in response to being interviewed. Reece said officers then gave the defendant a “midstream recitation of warnings after the initial interview process and interrogation.”

Reece also filed a motion to authorize the use of live video equipment for the transmission of testimony from Paddock’s other four children.

Lynn Paddock also has been accused of beating Sean's siblings with PVC pipe.
