Gated Community Loses Annexation Fight

Carthage, N.C. — A judge ruled Monday that a gated community has no more right than anyplace else to fight off annexation by a municipality.

Sixty people who live in Pinewild do not want to be annexed by Pinehurst, where the Village Council voted to annex the community effective June 30 if legal issues are resolved by then.

Superior Court Judge Lindsay R. Davis Jr. said there is no legal question to decide. Mike Newman, the village's attorney, said the decision meant gated communities have no more power to resist annexations than any other property owners.

A federal lawsuit claiming the annexation is an illegal taking that will reduce homeowners' property values is pending.

I will be writing my Uncle in the Gen Assembly and telling him that I hope EVERY legislator that approves of this forced annexation is taken out of office in the NEXT election!!! I grew up riding motorcycles around Pinewild LONG before it was filled with half-million dollar homes. NO ONE in Pinehurst cared a thing about it then!!! The ONLY reason they want it now if for the HUGE taxbase. This is the single biggest travesty in govt. that is being allowed in NC today!! Everyone should write/call/visit their representatives and tell them this is UNACCEPTABLE!!!

WhenWillItStop: So, how about the fact that they're about to "finish" the Big Bang annexation and go after Gates Four? All I can say is that I made it out of Fayetteville just in time. (18 years ago now...)

I hope these people take this as far as possible. They only want the tax money from the residents - they aren't even considering annexing the poorer communities around this community because they will have to provide services for those residents - another example of government redistributing wealth at gun point.

I went through this in FayetteNam when they annexed the western part of the county, thus far all I got out of this was a green trash can and increased taxes!!

Its all about more taxes for the city, people are losing their rights daily, goverment controls everything we do or attempt to say. I moved from the city after our neigborhood was annexed. I'm sure it won't be long before they get annex the area where I now live.
