Durham DA fails to file paperwork for delay

Durham County District Attorney Tracey Cline would like to postpone a Monday hearing in a motion to have her removed from office, but she didn't file her request with the clerk of court.

Cline sent an email to the clerk's office Friday, saying she has been ill and has had difficulty lining up an attorney to represent her in the case. She asked that the hearing be delayed for two weeks.

No official motion was filed with the clerk's office, however, so the hearing is expected to begin Monday morning as scheduled.

Superior Court Judge Robert Hobgood suspended Cline last month, pending the hearing, saying there was probable cause to support a motion to have her removed.

Defense attorney Kerry Sutton filed an affidavit that alleges Cline has "brought the office of the Durham County District Attorney and the entire Durham County justice system into disrepute."

Cline has repeatedly accused Superior Court Judge Orlando Hudson in recent months of bias against her and has asked to have him barred from handling criminal cases in Durham County. Two other Superior Court judges have found Cline's complaints to be groundless.

Either Tracey Cline is incompetent or she is arrogant beyond belief. I mean, come on. Even a first year law student knows you file motions with the Clerk of Court. You are not so important that you get to bypass the normal process and just e-mail the judge directly.

Tracey Cline can't find an attorney to take her case? How interesting. I bet that no attorney wants to be associated with Cline in any way.

Hopefully the hearing on Monday results in Cline's permanent removal from the DA's office.

again she can't even defend her self correctly.
