DURHAM, N.C. — A 3-year-old Henderson girl was recovering at Duke University Medical Center Friday after being struck by an SUV.

Jatoya Kingsberry was in fair condition after she was hit Thursday evening, while walking with her mother along Clark Street in Henderson to a store.

Shawanda Knott, the girl’s mother, said the toddler saw someone across the street and ran into traffic.

“Everything just happened so fast,” she said.

Witnesses told police that the SUV’s driver, Monkevious Peace, 19, was driving at a high rate of speed.

Peace said Friday that he wasn't speeding and there was nothing he could do to avoid hitting the girl when she ran in front of him.

Henderson police were still investigating the wreck and could decide by early next week whether to file charges in the case.

“I just thank God that Toya – you know,” the girl’s grandmother, Joyce Kingsberry said. “It could have been worse than what it was.”
