Report details standoff at police substation

Around 1:10 p.m. on Sept. 30, Justin Lamar Thomas, 25, discharged a firearm into the air outside the South West District Police Station at 601 Hutton St., according to the report.

Lt. Niemann and several other officers went outside to investigate the gunshot. When they approached Thomas and identified themselves, he displayed two handguns, the report stated. Officers ordered Thomas to put down the guns, but he refused and walked away.

Thomas entered the offices of NCSU ComTech at 628 Hutton St., ordered the employees to leave and then barricaded himself inside, the report stated.

Officers saw Thomas pointing his guns at his head and waving them around in the air, according to the report. Officers attempted to evacuate everyone in the area.

Thomas, still carrying the handguns, repeatedly came outside the building, but wouldn't respond to officers who talked to him, the report stated.

Around 2:30 p.m., he came to the rear exit, where Sgt. C. Rosa, 42, Senior Officer D.G. Batton, 34, and Master Officer F.M. Patercity, 30, were stationed. Rosa ordered Thomas to drop his weapons, but he pointed one handguns at his own head and went back inside.

A few moments later, he came back out with the handguns and pointed them in the general direction of the officers, according to the report. Thomas was told to drop his weapons but refused.

When Thomas came out a third time with a handgun in each hand, Rosa again commanded him to drop the weapons. Thomas, though, began bring the handguns up and point them at the officers, according to the report.

Rosa, Batton and Patercity each fired one round at him, the report stated. Thomas was struck one time and fell to the ground.

Paramedics transported Thomas to WakeMed, where he was listed in stable condition.

Upon his release from the hospital, Thomas will be charged six counts each of second-degree kidnapping and assault with a firearm on a law enforcement officer and one count each of going armed to the terror of the public and discharging a firearm within city limits.

Rosa, Batton and Patercity are assigned to the department’s Special Operations Division. Following departmental policy, they have been placed on administrative duty. As is standard procedure when a law enforcement officer fires a weapon, the State Bureau of Investigation is investigating the shooting.

The SBI's report will be given to Wake District Attorney Colon Willoughby, and Raleigh police supervisors will review the internal report.
