Cary police: Man left party, broke into house, raped woman

Gavin John Clevesy, 17, was charged with first-degree rape, kidnapping, sexual offense and burglary, along with assault with a deadly weapon with intent to kill inflicting serious injury and simple assault. He was being held Sunday evening in the Wake County Jail under a $2.5 million bond.

Investigators said that Clevesy was intoxicated when he left a party in the McGregor Downs neighborhood shortly before 9 p.m. Clevesy began knocking on doors, and a couple, both in their 60s, answered at a home on Edinburgh Drive, police said.

"The victims opened the door to address what was going on with him, and he made entry into the house," Capt. Michael Williams, with the Cary Police Department, said. "He wound up assaulting both the husband and the wife."

Clevesy hit the man over the head with a statue, the warrant said. The woman managed to escape from the house and went knocking on doors, asking for help, police said.

"The suspect went out after her and wound up committing a sexual assault and a rape upon her," Williams said.

A driver, however, saw the assault taking place. He intervened, stopped the assault and detained Clevesy until police could arrive, Williams said. Residents said they thought the Good Samaritan was a guest at a nearby wedding reception.

"We were able to arrest him immediately," Williams said.

Both victims were being treated Sunday at WakeMed.

Police said they believe this was an isolated incident, and residents said violent crime is extremely unusual in their neighborhood.

"I'm totally stunned. I'm shocked. We walk here every Sunday morning," said Linda Nixon, who has lived in McGregor Downs neighborhood for 11 years. "We've had garages broken into; that's been the only major crime I've known of, golf clubs being stolen out of cars."

A WRAL News reporter spoke with Clevesy's mother, who was visibly upset. She managed to say that her son is not a bad kid.

Nixon said that her neighborhood will have to struggle to understand what took place.

"I don't know that you really have a reaction. It's just a difficult situation," Nixon said.

Clevesy pleaded guilty in March to communicating threats against a person in Cleveland County, according to court records. He was ordered to be assessed for anger management, stay off Cleveland County school property and not to assault, threaten or harass a certain individual. He was sentenced to 18 months probation.

Clevesy was also sentenced to probation in June after being convicted of disorderly conduct and possession of drug paraphernalia in Onslow County, according to state records.

He has a conviction in Wake County for a hit-and-run, damaging property in May 2007.
