Keith Barnes will not be charged in the July 22 shooting of his father, the Johnston County district attorney has decided.

Cody Barnes said his brother Keith, 26, was arguing with a man in the front yard of his home at 704 W. Parrish Drive in Benson. His father, long-time bail bondsman, Tony Barnes, 50, tried to stop the argument.

"And the boy got on top of my dad, and my brother came out with a shot gun, shot and hit my dad, pretty much," Cody Barnes said.

Cody Barnes said the shooting was an accident and that his brother was trying to shoot the other man.

Tony Barnes underwent surgery at WakeMed and is currently listed in fair condition.

I agree with this.... I would not think that there should be any charges filed

Negative responses are all that goes through some people's minds and that is all they can think of and sure can not put themselves in other people's shoes. They have to judge others to put their two cents in on something they know nothing about. I hope Mr. Barnes will be ok as alot of people are praying for him, his family and this whole ordeal can be put in the past.

Well, to the 2 negative comments, everyone has their own opinions. Yes, the other guy was sprayed with the pellets but unfortunately he did not get the impact he needed. In times such as this I guess it is hard to take your time and make sure your aim is perfect. He at least made the effort to get a nonlethal weapon instead of a real one. "These people" have guns because everyone has the right to bear arms and has the right to protect a third-party especially when someone such as Brandton Tart, a known felon, that has not only assaulted Mr. Barnes, but his brother, his father and several other individuals trespasses on their property for no reason and starts assaulting people.

The victim's son used a shotgun, loaded with non lethal, rubber pellets, which are made to sting or cause severe pain. Considering the closeness of the son to his father, it proved to cause way more severe injuries. It's very common for bail agents to carry this type of ammo.

What I want to know is, did ANY of the gunshot blast hit the other man that was jumping on his Dad?!?!? I'm all for the right to bear arms, but you need to learn how to aim a little better than that before exercising that right! I understand the son's wanting to defend his Dad, but come on, how in the world did he shoot his Dad and not hit the intended at all?
