DURHAM — A grand jury has indicted the man police say was drunk when he allegedly caused a fatal accident. Timothy Blackwell faces charges of murder, habitual DWI and four counts of assault with a deadly weapon.
Police say Blackwell smashed into a minivan in Durham County last Thursday, killing a child and injuring four of her family members.
Blackwell, who has been convicted of DWI before, returns to court next week.
Meanwhile, a memorial fund for 4-year-old Megan Elizabeth Dail, who was killed in the accident, has been set up at BB&T Banks all over the Triangle. The fund will help pay for funeral and medical expenses, and help replace the two family vehicles which were involved in the accident.
Megan Dail was buried Monday.
