Judge Dismisses Wrongful Death Lawsuit

FAYETTEVILLE — A federal judge has dismissed alawsuit filed by the mother of a mankilled by a Fayetteville police officertwo years ago.

U.S. District Court Judge James C.Fox says Officer T.P. Riley wasjustified in using deadly force.

On Jan. 31, 1994, Anthony Maurice Baldwin exchanged gunfire with anofficer who tried tostop him outside a Raeford Road bank. Neither manwas injured and Baldwin fled, leading officers on a car chaseat speeds of more than 100 mph and firing a shotgun atpolice while driving.

One of those who pursued him was Officer T.P. Riley. The chase ended in achurch parking lot on Hope Mills Road. There,Riley fired after Baldwin jumped from his car and ran away. Baldwin, 23,was shot once in the back of the head.

Riley said that he thought Baldwin still held the shotgun he had fired atpolice. Police later determined Baldwin dropped theweapon in another spot as he ran.

Police said Baldwin was planning to rob the Southern National BankonRaeford Road when he met up with aFayetteville police officer and opened fire. In the days after theshooting, the FBI determined that Baldwin had robbed a HopeMills bank the week before.
