Misdemeanor Noise Charge Dropped Against Duke Lacrosse Player

DURHAM, N.C. — One Duke lacrosse player walked out of court Tuesday with a clean record.

A judge dismissed a misdemeanor noise violation against team captain Dan Flannery. The charge stems from a party thrown at 610 North Buchanan last January.

Flannery lived in the house with Dave Evans, the third player indicted in the case. Evans is supposed to be in court next week for the same violation.

Even though Flannery's case was dismissed, the assistant district attorney said they would still pursue the charge against Evans.
