Judge Decides Not To Rule On Wife's Detailed Timeline In Military Love Triangle Case

FORT BRAGG — A military judge has decided not to rule on a piece of evidence in the case against a murdered Air Force captain's wife.
Michelle Theer was in court Monday trying to prevent a detailed timeline she wrote from being used in the murder trial of Army Staff Sgt. John Diamond.
The judge decided on Tuesday not to rule on the timeline document, but did say e-mails Mrs. Theer discovered about alleged affairs her husband was having should be turned over to the prosecution.
In what police call a love triangle, Diamond is charged with killing Theer's husband, Capt. Marty Theer. Michelle Theer has never been charged in the incident.
