APEX — Developers in the town of Apex are going to court to stop the limits on housing permits.
Earlier this year, town commissioners voted to limit growth over four years until expansion is complete at the town's sewage treatment plant.
This week, however, the developer of a subdivision off NC-55 filed suit in Wake Superior Court, claiming the town promised all the building permits he would need for the project when it signed on in 1984. The town had said water and sewer service would also be available.
Town leaders are not commenting on the lawsuit, but they do stand behind their decision to limit growth.
