Toddler Dies from Crash Injuries

CLAYTON — A toddler involved in Tuesday's crash in Johnston County has died. Twenty-month-old Megan Avery passed away Wednesday at Duke Medical Center.

A second victim, five-year-old Jonathan Staggers was last listed in good condition at Pitt Memorial Hospital.

A driver who fell asleep at the wheel caused the accident and a fire. Police say Tammy Avery, 28, of Clayton, was driving a van on Highway 42 near Clayton when she fell asleep. The van hit a bridge and spun around, causing the car behind it to hit the van. Both vehicles caught fire on impact, and both were destroyed, but none of the five occupants were burned.

Avery, her 7-month-old daughter and the driver of the car were taken to Johnston Memorial Hospital where they were treated for minor injuries.

State troopers say the 7-month-old child was in the backseat of the van in a safety seat and Megan Avery was in the front seat in some type of child restraint seat. Troopers did not know if the children were properly restrained, however.

No one has been charged yet, but troopers say charges are pending.
