DURHAM, N.C. — Durham police filed first-degree murder charges Friday for the 1997 shooting death of Michael Stevon Hunter against a man currently incarcerated in jail.

Police said Hunter was killed during a drive-by shooting on Nov. 24, 1997, as he stood on the front lawn of Happy Rock United Holy Church.

James Mark McClain Jr., 25, has been charged with Hunter's death. McClain Jr. is in the Franklin County Jail waiting to be transferred to federal prison to serve a 22-year sentence for drug distribution.

Police believe the shooting was a case of mistaken identity.

Though McClain has been charged with first-degree murder, the homicide investigation remains ongoing, police said. Anyone with information about Hunter's death is asked to contact Investigator A.L. Jackson at
