Man Convicted In Drunken-Driving Case To Be Resentenced

DURHAM, N.C. — A man convicted twice of killing a Durham girl in a drunken-driving crash will be sentenced again.

Authorities said Timothy Blackwell was drunk and high on drugs when he killed 4-year-old Megan Dail in 1997.

Blackwell was convicted of first-degree murder, but the conviction was later overturned. Three years ago, Blackwell was retried, found guilty and sentenced to up to 50 years in prison.

Blackwell's lawyers argued, however, that the judge did not follow the law when he handed down that sentence. The North Carolina Supreme Court agreed and Blackwell will now be resentenced.
