RALEIGH, N.C. — The state set an Oct. 8 execution date for Sammy Perkins.
Perkins was convicted of killing 7-year-old Lashenna "Jo Jo" Moore. Perkins was dating the little girl's grandmother.
Authorities say Perkins raped and killed Moore in the grandmother's home in 1992.
Perkins was scheduled to die by lethal injection earlier this year, but a U.S. District Court Judge stayed the execution because of a legal challenge.
