— Charges are pending against a driver who crossed the center lane of Jones Sausage Road in Garner Friday afternoon and hit another vehicle, killing a child.

According to Sgt. Jorge Brewer, spokesman for the state Highway Patrol, Kimberly C. Davis, 36, of 5530 Talserwood Drive in Raleigh, caused the head-on collision.

Five people from the other car were taken to WakeMed, where an infant, 8-month-old Casandra Gandarilla, was declared dead. Karen Martinez, 19, Juan Guzman, 53, Rosa Martinez, 51, and Brian Gandarilla, 4, were still in the hospital Saturday night.

Casandra was not properly restrained, Brewer said.

State troopers planned to consult with the Wake County District Attorney's Office before filing charges.

Anyone know why the driver crossed the line? Purely an accident or alcohol? While nobody heads out in their cars planning to cause a fatal accident, it does happen and it's terribly unfortunate if it was truly an accident that the driver at fault would be charged. And, why are the parents not charged for failing to secure the child?

How tragic this child wasn't properly restrained; her parent will have to live forever with the knowledge the child would most likely have survived otherwise. So sad.
