A Middlesex man has been charged with driving while impaired and reckless driving after a fatal accident Tuesday near the Wake-Johnston county line.

According to a statement released by the Highway Patrol, the collision occured about 12:35 a.m. Tuesday near TV Tower Road. A 2003 Chevrolet Impala car driven by Nilious Banks, 32, of Middlesex, was traveling east on U.S. 70 at an estimated 90 miles per hour when he craashed into the back of an east-bound Chevrolet sport utility vehicle driven by Lawrence Bush, 34, of Clayton.

Bush died at the scene. Banks was charged with driving while impaired and reckless driving.

Banks and his passenger, Ricky Jan McFarland, 23, of Clayton, were injured in the collision and transported to WakeMed.

The collision forced Bush's vehicle off the road to the left. It overturned, and Bush was ejected.

Banks' vehicle ran off the road to the right and collided with an embankment.

The Highway Patrol said Bush was not wearing a seat belt.
