Judge: Peterson Attorneys Cannot Force Media To Discuss Alleged Leaks From Police
Posted — UpdatedDURHAM, N.C. — A judge ruled Mike Peterson's attorneys will not be able to force the media to talk about alleged leaks from Durham police.
David Rudolf argued two Durham officers lied on the witness stand about giving information to the media. He wanted three members of the press, including WRAL's Julia Lewis, to testify about what the officers told them.
Judge Orlando Hudson ruled the media's First Amendment rights were more important than the possiblity of perjury. Rudolf announced plans to appeal the ruling.
Rudolf also asked that opening statements be delayed until July 1 because his lead investigator suffered a heart attack Tuesday.
Peterson is charged with the death of his wife, Kathleen, in December 2001.
