DURHAM, N.C. — A woman who was hit and critically injured on Interstate 40 may have also been the victim of an assault.

Durham police say Tricia Gerke accepted a ride in Raleigh from three men she did not know Friday morning. Gerke told police the men made sexual advances. She claims when she refused, the men hit her and made her get out of their car.

Police say Gerke was walking along the highway when she was hit by a Ryder truck.

Durham police say the assault happened out of their jursidiction, in Wake County. Gerke's family is concerned police are simply dismissing their daughter's claims.

"Whether the individual makes bad choices or not, a crime is a crime and we investigate it and the appropriate steps and measures are taken at the conclusion of the investigation," said Lt. N.J. Blake, of the Durham Police Department.

Gerke's family is considering filing a police report in Raleigh. Gerke is listed in critical condition at Duke University Hospital.
