SMITHFIELD, N.C. — No charges will be filed against a teacher accused of putting a child in a trash can.

Kimberly Stancil said when she went to South Smithfield Primary to pick up her son Kaleel, he was inside a trash can. Her son suffers from Down Syndrome.

Witnesses said Kaleel had been placed in a trash can several times because he acted up.

The district attorney said there is nothing criminal about the case, but Kaleel's mom could pursue a civil lawsuit.
