DURHAM, N.C. — A Durham man who said he shot and killed a man who was trying to break into his house will not face charges.
Monday, District Attorney Jim Hardin threw out charges against James Hill Jr., who spent time in jail for the shooting.
"I'm sorry about what happened, but I'm glad we can move forward," Hardin said. "I always had faith that this is the conclusion that would come forth."
Early Christmas Eve morning, Hill shot and killed 26-year-old Jermaine Hart. Hill said Hart tried to break into his home and came after him with a brick.
"As far as I am concerned, the process worked. They (the grand jury) did the right thing and made an appropriate finding. I'm not going to try to disrupt that," Hardin said.
Hart's family said that they are very disappointed with the decision.
