Who Enforces the Class-Size Law?

Q: According to G.S. 115C-301, if the superintendent willingly does not comply with the law regarding the maximum class size, he is not to be paid. Who actually enforces the law?

A: The statute you are referring to says that the State Board of Education has authority to enforce the law.

At the end of the second month of each school year, every local board of education, through the superintendent, files a detailed report about their schools. The report includes the organization for each school, the duties of each teacher, the size of each class, the teaching load of each teacher and any other information the State Board requires.

“If the State Board of Education determines that a local superintendent has willfully failed to comply with the requirements ... no State funds shall be allocated to pay the superintendent's salary for the period of time the superintendent is in noncompliance,” according to General Statute 115C-301.

What do they do with our tax money - fly off to accept awardsin California for superintendent of the year when the parents do not get to vote for or against him/her?

I know this is pointless, but it is aggrivating the way they squeezed 27+ kids into a tiny classroom or mobile unit and keep adding more every month.

So long as you want to fork over the extra money to gather and report this information every month contact your state reps to get the law changed. Of course reporting the numbers won't matter. If a student shows up. they have to let them in.

They check it ONCE after the first two months of school? This is a dumb idea! They should check this EVERY month because our school is somewhere in the neighborhood of 200+ over capacity and new students continue to arrived at the school door AND are taken in.
