NC dentists sue feds over teeth-whitening rules

— North Carolina's dental regulatory board filed suit Tuesday to enforce a state law that allows only dentists to perform teeth-whitening procedures.

The state Board of Dental Examiners alleges that the Federal Trade Commission overstepped its authority in trying to determine who can whiten teeth. Last year, the FTC accused the dental board of improperly trying to shut down businesses like day spas and tanning booths that also offer whitening services.

The board wants a federal judge to issue an order upholding its right to determine who can offer whitening services and requiring the FTC to remove all derogatory references to the state board and North Carolina dentists from the FTC website.

    If kind of funny you liberals think gov't controlled healthcare controls cost. The cost of Medicare and Medicaid was increasing 2X that of private healthcare insurance. Considering Obamacare is raising healthcare premiums 20%-49% across the country, it wasn't going to save money either.-Worland

    Yeah, health-care costs were in the 'sweet spot' before Obama. (they NEVER raised, year after year after year) I guess thats why he ran on 'Maintain the Status Quo' and not "Hope and Change."

    Yea right on needing a dentist to sell me a $500 night guard. I have had both prescription and mail order and they are the same quality and fit. Just no padding a dentist's greedy pockets.

    Rising cost are why reform was needed. Now maybe medicare wont bankrupt us.

    I am a hairdresser and I personally have whitened friends teeth with a simple clorox pen while they are having their hair dyed. You just need to make sure you stay away from the gums. I normally use cotton gauze along the gums, apply the bleach pen and then after 15 minutes a quick mouth rinse and it looks better than any dentist office could do!

    It's kinda' funny. A lot of you are complaining about the high cost of dental health care yet I would bet most of you whiners oppose legislative attempts to control costs as "unconstitutional".

    Anyone that would let some unskilled, disaffected worker bleach their teeth should be slapped silly. Do they sterilize the equipment? Do these workers understand infection/disease control? Do they perform any sort of exam to see if you have healthy gum tissue? I'm no dentist but, these

    OK...here we go..now from a dental office point of view. #1..no not same labs...in NC we have to write a Rx to a lab to fabricate anything..a partial, crown or night guard. And by law the labs cannot make anything without the Rx. Now about the whitening. There is whitening which you can do OTC. Then there is bleaching, which can only be done under the supervision of a dentist. People don't realize there is a difference between whitening and bleaching. Now these Kiosk in the mall...problem there...no running water...heard of sterilization? You would be amazed at what we have to do to just the dental chair and immediate area between each patient..I have witnessed the sanatation practices of these whitening kiosks.....not so good. When it comes to athletic mouth pieces for children with mixed dentition...we recomend the cheapo Walmart one...about $4..then get a good one when all the perm. teeth are in that is a custom fit when and if they continue with sports. Yes it may cost $40

    I got my glasses mail order from china for 10 dollars. Next you will tell me I'm gonna go blind because I didn't spend 300 dollars. These health care providers are running a rackett because they know how important the services they provide are. We all need these things so we cough it up. When a cheaper alternative comes to light they try to scare us with made up horror stories.
