Mistrial declared in fatal Orange shooting

— A judge declared a mistrial Thursday after an Orange County jury deadlocked in the trial of a man charged with shooting and killing his stepfather.

Jurors split 8-4 in favor of convicting William Stroud of voluntary manslaughter in the death of Marshall Brown during an altercation in which Brown attacked Stroud with a baseball bat.

It was unclear whether prosecutors will attempt to retry Stroud in the case.

    Let's see; some guy is wailing on you with a baseball bat, but you have no bat. So what are you supposed to do? Head on down to a sporting goods store and get one or maybe just use something else that could deter the attack? Seems to me that there are 8 jurors that may need to have actually witnessed some violence or there is more to this than reported.

    Seems like some of the jurors believed it was self defense. But the usual question is was it equal force or greater force. If he attacked back with a bat or something similar it would be pure self defense but using a gun is a greater force and may result in manslaughter.

    If Brown was attacking Stroud with a baseball bat, why wouldn't the killing have been self defense?
