Man with pistol, pot arrested at Enloe High

— A 20-year-old man was arrested Friday morning at Enloe Magnet High School in Raleigh and charged with drug and gun possession.

Asaiah Ben Yisrael, of 5121 Bedell St. in Raleigh, is not a student at the school, a police spokeswoman said, but he was on school property while students were present.

Yisrael is charged with possession of marijuana with intent to sell and possession of a gun on school property.

    I'm genuinely curious because I don't understand the laws pertaining to pistols, and I know they're different from long guns.

    You said he would be violating the law to have the gun on school property because he'd have to have a concealed permit but to get that he'd have to be 21; since he's only 20 we can make the assumption he has no permit.

    However, if I understand you correctly, to purchase, inherit, etc. a pistol you have to be 21 but you can be in possession of one if you're under 21? Is that right? I'm not taking a stand either way ... just trying to understand the law.

    I bet if they made the minimum sentence for unlawfully possessing a firearm 15 years in prison, we'd start to see these +hugs carrying less guns.

    Adding to my comments about purchasing: This guy was definitely unlawfully carrying a handgun, even though, possession of the firearm by a 20 year old is not necessarily unlawful. He was unlawfully carrying because of the drugs. He would be further unlawful because the carry on a handgun on school grounds requires a concealed handgun permit. You gotta be 21 to get one of those.

    Personally, I like the idea of throwing him under the jail. I would add throwing away the key. At least for a little while. Just to throw a little scare into him and those who would follow, if for no other reason. ;)

    NCGS14-402(a) requires a pistol purchase permit, or a concealed handgun permit, for any person, firm, or corporation to sell, give away, transfer, purchase, or receive at any place in the state. This even includes inheritances. You gotta be 21 to get that permit.

    Persons under the age of 21 may not purchase handguns, or their ammunition, from an FFL. Persons under 18 may not purchase long guns, or their ammunition, from an FFL. That's federal law.

    Purchase and possession are two different things. Not going there for the purposes of this discussion.

    Only from a FFL. One can buy one in NC from a private party at 18.
