Man charged with DWI in fatal Durham crash

— Two brothers were killed early Friday in a head-on collision on N.C. Highway 98 in Durham, authorities said.

A 2010 Dodge Ram pickup driven by Robert Portner Breeden III was westbound on N.C. 98 at about 5:50 a.m. when it crossed the center line and collided with an Isuzu Rodeo SUV driven by Jorge Avalar near the Coley Road intersection, according to the North Carolina State Highway Patrol.

Avalar, 43, and his brother, Andreas Avalar, 47, both of Ruby Ridge Drive in Durham, died in the wreck.

Breeden, 20, of 10900 Cahill Road in Raleigh, was charged with two counts of felony death by motor vehicle and driving while impaired.

Marijuana is suspected as a factor in the crash, authorities said. Troopers are waiting on the results of a blood test to determine how much marijuana was in Breeden's system.

Breeden has previously been charged with a hit-and-run with property damage in Wake County and possession of synthetic marijuana in Chatham County. He's due in court on those charges next month.

    There is a BIG difference between synthetic marijuana and the real thing. The police don't even sound certain that marijuana was involved. Just because someone tests positive for marijuana doesn't mean they are high. Marijuana shows up positive in blood tests for 30 days after consumption.

    Educate yourselves, teetotlers. Learn the difference between marijuana and chemical drugs. It's an eye opener.

    You have a lady working 2 jobs and barely making it raising 5 kids making minimum wage.One of her kids is doing drugs and making hundreds of dollars a day,you think she is going to tell him to just say no?"

    Not correct Mike. DUI is driving under the influence. DWI is driving while intoxicated. They changed it to DUI to cover all.

    Actually, the charge is Driving While Impaired (DWI) and it replaced Driving Under the Influence (DUI) in NC back in 1983. It was changed to DWI to reflect alcohol, drugs (legal or otherwise) and even sleep deprivation.

    It doesn't say anything about driving drunk, it says "...while impaired" and mentions marijuana. Pot kills, NC is way too lenient on the junkies that use it.

    We do have too many in jail for pot. Prohibition has never worked. You think that because alcohol contributes to auto accidents and deaths, that we should lock up people who drink? What we should do is enforce the laws that make driving under the influence a crime. That has nothing to do with whether pot or alcohol should be legal to consume.

    Law enforcement is not doing enough to round up and bust these street gangs that proliferate the drugs. That's you Roy Cooper!

    I know many are upset that the GOP is turning things upside down, but look at the damage done by the other side who possessed power for so long.
