Man arrested in Durham shooting that injured two

The man was charged with two counts of assault with a deadly weapon with intent to kill inflicting serious injury, one count of assault with a deadly weapon with intent to kill, shooting into an occupied vehicle and failure to appear.

Shortly before 5 p.m. Monday, deputies responded to reports of gunshots at the intersection of North Mineral Springs Road and Daniel Drive, where they found Phillip Banner, 26, shot in the back and Jarrod Carrington, 20, shot in the leg.

Deputies said the suspect and the victims knew each other, but that a passing motorist also got caught in the crossfire of the shots. That person got out of the vehicle and ran away from the scene without being hit.

Banner was treated and released from Duke University Hospital. Carrington had surgery Monday night and was still at Duke on Tuesday, but his injuries are not life-threatening, authorities said.

Joshua Jones, 16, was arrested near the scene of the shooting and charged with possession of a stolen hand gun, authorities said. It wasn't clear whether he was involved in the shooting.
