Lovette court hearing scheduled today

A motions hearing scheduled today for Laurence Lovette, who was convicted in December of killing University of North Carolina student body president Eve Carson.

He's also charged in the murder of Duke graduate student Abhijit Mahato. That case has not yet gone to trial.

Lovette is already serving a life sentence without parole for Carson's murder. He was 17 at the time of the crime.

Last month, the U.S. Supreme Court ruled that juveniles cannot automatically be sentenced to life without parole.

It's unclear right now how that ruling could affect his case.

    in addition to the sillyness of such a debate, considering he's likely guilty of yet another murder on top of this, THIS is more money sucked out of taxpayers, and into the lawyers pocket.
    What a great game they have going. Make laws that are not clear, so that future lawyers can line their pockets discussing it. It would be funny if it wasn't so sad.

    Just because the SCOTUS ruled that a juvenile cannot AUTOMATICALLY be sentenced to LWOP, that doesn't mean that a juvenile cannot BE sentenced to LWOP. Just like when they ruled in the 70's that the death penalty could not be an automatically imposed sentence, states will now have to come up with a process for jurors to follow that provides for "guided discretion" in deciding whether someone under age 18 should be sentenced to LWOP or not. This will result in certain aggravating and mitigating factors being taken into consideration, I imagine, just as they are in sentencing to death. It does NOT mean that no one under age 18 at the time of the commission of the crime will ever be sentenced to LWOP.

    I was thinking at in NC, 16 is considered "adult" for prosecution purposes. Or at least it used to be (I am not in NC now)

    I have a daughter attending UNC in the fall, and all I can think about is Eve Carson!! I will have alot of sleepless nights!!
