My First Citation. Some Advice Please?


First off, let me say this:
I wasn’t speeding.
Really.
What I did was slowly roll through a stop sign at a corner in my subdivision on the way out this morning and BAM!
Flashing lights in my rear-view mirror.
Wrong? Absolutely! I’ll be the first to admit that.
But a citation for $160?
In my mind, that’s a bit excessive, but I’ve only been living here for two months and maybe that’s standard in North Carolina.
But what I need to know now is if showing up in court will be beneficial.
The police officer indicated that they might work with me since it’s my first citation here and I haven’t had any citations in the last three years.
So, if you have any experience with traffic violations, give me a clue.
Mail in the $160 and avoid the hassle?
Or go to court and hope for the best?

STOP could stand for "slight tap on pedal", but not in Holly Springs. It is said that the Holly Springs police force is so well staffed due to it's population growth and subsequent huge increase in tax base, there are a lot of officers looking for even the most minor infractions. So, be careful in Holly Springs. Also, Cary and other local municipalities like to take your picture if you happen to go through one of those "pink" lights at certain intersections. In those cases you get a citation in the mail. I guess we are just being well protected in Wake County.

I dont work for him... but you want to talk to a Ral atty... Greg Seibert... he's good and he's worth the money...

Trust me ... pay the 75 or 100 bucks an atty will cost... you will save big $$$ in the long run.

Do not send in the money. That is an admission of guilt, then your insurance will go up. Get a lawyer, might cost around $200,(they can make it where it will not show up anywhere) but no increase in insurance premiums which is well worth it. Your insurance premiums will go up for 3 yrs.

Do not use the Prayer for Judgement. You can (a) go to the magistrates office and ask that it be dismissed (I did it one time for my then wife speeding 38 in a 25) or (b)go to court and the Judge or DA will most likely reduce it. If you fully admit you were wrong, they will be more willing to work with you. Save the Prayer for Judgement for something more serious. Tgwn03--A Prayer for Judgement is an admission of guilt however the offense is "in limbo". If, within the next three years, you are cited for another violation, you will be prosecuted for both voilations. If your record is clean during those three years, it is dismissed. Beware, you can only use it once in a lifetime, so make it worth your while.

As the queen of traffic tickets, go to court. Ask for a Prayer for Judgement Continued (PJC). That means they will "overlook" this ticket and it won't count against you. But...you can not get another ticket within 3 years or else both will count against you. Most recently I went to court for a speeding ticket and only 2 years had passed since my last PJC. The judge offered me a PJC instead of going with a reduced speeding charge! Some of them are nice like that! You'll still have to pay court costs, but it won't be $160 and you won't have to worry about anything on your record!

Well unfortunately, you've admitted in public that you were "Wrong? Absolutely! I’ll be the first to admit that." The DA's office could use that as an admission of guilt if you were to plead not-guilty.

Having said that, if at all possible, at least show up for your court appearance and ask the DA what your options are. Since the last thing they want to have to deal with is you pleading not-guilty (time involved, arresting officer must be there and testify), they will surely offer a better deal than signing a guilty plea and mailing in the $160. The Prayer for Judgement Continued (PJC) idea is available IF you don't have anything against your record for the last 3 years. However if you do use it, anything else on your record between now and 3 years from now, will cause BOTH to be counted in your insurance points.

Also, assuming this is Wake County, show up about lunchtime - they get really backed up first thing in the morning.

I have a better one. I got a ticket from an officer that was not in her car nor did she ever stop me. She was making an arrest in my neighborhood and my neighbor told her he has seen me speed. She then wrote me a ticket because I stated that the speed is 25 so I got a speeding ticket for my mouth.

I was stopped on Thanksgiving Night :) of all nights to give thanks Huh? I did the same thing that you did. It is called a "California Roll" at least that is what the cop called it. I called it "#&*$^&*Q^#&*Q!" BUT the law is the law and I guess because it was Thanksgiving Night he decided to give me a break and issue me a warning. So see, I cant give you advice about the ticket, but I can tell everybody else out there that if you dont come COMPLETELY to a STOP at a stop light, they will get you and you may not get as lucky as I got that night.

Whatever you do, do not get a prayer of judgement. I only say this because if you do (and you would likely be awarded it being this is your first offense), keep in mind that you have to have a spotless driving record for the next three years. Otherwise, if you were to get a ticket, you will be liable for that ticket plus your first ticket for running a stop sign. Imagine what that'll do to your wallet on both the ticket ($160 plus whatever the new ticket costs) plus on insurance premiums and points.

I was advised that instead of doing that, have the lawyer file a defense of a mechnical failure (I forget the exact thing they did). This way it does not appear on your insurance, the costs is less (although technically you are still paying the fine... it just will not show up on your driving record nor will it show up on your insurance).

Do your research and I am sure you will find the answer easy enough.

You might have a clean record but i am pretty sure that they will not completely drop the citation.The State of North Carolina wants that money. Your best bet is to go to court and have them reduce the charge to a speeding infraction, say 44 in a 35 mph zone,or if the DA would bump it down to improper equipment,your fine would be reduced a little but your insurance will not go up. You can save the PJC if you receive another citation within three years.
